Pleader for Home, appearing for respondent Nos. 1 to 5.

4. Learned Assistant Government Pleader for Home submits

that neither the police nor respondent No. 5 have ever forced

the petitioners to close their shop or interfered with their

business activities without any lawful basis. However, he fairly

submits that this Court, by an interim order dated 13.03.2019,

directed that the petitioners shall not be prevented from

operating their shop unless it comes to the notice of the police

that the petitioners are indulging in or abetting malpractices

during the ongoing public examinations. In view of the said

circumstances, he prays for passing appropriate orders.

5. I have perused the material available on record.

6. The grievance of the petitioners is that respondent No. 5

has been interfering with their business operations during the

conduct of Intermediate and S.S.C. examinations, both regular

and supplementary. Having regard to this contention, the

interim direction earlier issued by this Court, and the

limitations of the police in such matters, respondent No. 5 is

directed to refrain from interfering with the petitioners’

business, except in strict accordance with law and by following

due process.

7. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
