CRLP 15872/2025

IN THE HIGH COURT FOR THE STATE OF TELANGANA

AT HYDERABAD

THE HONOURABLE SMT. JUSTICE K. SUJANA

CRIMINAL PETITION No.15872 of 2025

DATE: 17.12.2025

BETWEEN:

K. Parsuram

…..petitioner/accused No.4

And

The State of Telangana,

Rep. by Public Prosecutor,

High Court for the State of Telangana,

at Hyderabad.

…..Respondent/complainant

ORDER

This Criminal Petition is filed under Section 482 of

Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.4 in Crime No.427 of 2025 before the Chilkalguda

Police Station, Secunderabad, registered for the offences punishable under Sections318(4), 336(3), 338 read with 3(5) of BNS.

2. The brief facts of the case are that accused Nos.1 to 3 had availed personal loans from SBI, Padmarao Nagar Branch, Hyderabad, by submitting fabricated salary statements, pay slips, and employment documents, thereby causing a wrongful loss of Rs.24,96,406/- to the bank. Based on a complaint by the Chief Manager, an FIR No.427 of 2025 was registered. The petitioner was later arrayed as accused No.4 on the basis of the statement of accused No.1, who is his cousin. The petitioner, a Central Government employee working in the Defence Department, claimed that he had only received Rs.5,00,000/-

from accused No.1 towards repayment of a hand loan.

3. Heard Sri B. Ramulu, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent – State.

4. Learned counsel for the petitioner submitted that the petitioner had been falsely implicated based solely on the confession of accused No.1, which had no evidentiary value without corroboration. He further submitted that there was no material linking the petitioner to the alleged fraud and that the police, without proper verification, mechanically included him as an accused. He contended that the petitioner, being a law- abiding government servant with no criminal antecedents, faced an imminent threat of arrest which could severely affect his service career. Therefore, he prayed the Court to grant pre-

arrest bail to the petitioner by allowing this criminal petition.

5. On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by learned counsel for petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the Criminal Petition.

6. Having regard to the rival submissions made and on going through the material placed on record, it is noted that previously the petitioner had filed Crl.P.No.13667 of 20245 before this Court, seeking the relief of grant of anticipatory bail and the same was dismissed vide order dated 07.11.2025 observing that ‘an amount was transferred to the account of the petitioner, and the main allegation against the petitioner is that he, along with accused No.5, fabricated and forged the TSPDCL identity card. Further, as the investigation is not yet completed, considering the gravity of the allegations, this Court is not inclined to grant pre-arrest bail to the petitioner, and the same is liable to be dismissed’. However, it is noticed that there are no changed circumstances back then in the earlier bail petition, and the present bail petition. As such, this Court is not inclined to grant the relief as sought for, by the petitioner. There are no merits in this Criminal Petition, and the same is liable to be dismissed.

7. Accordingly, the Criminal petition is dismissed.

Miscellaneous applications, if any pending, shall stand closed.
