ORDER:

This Writ Petition is filed with the following relief:

“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents 1 to 3 in not opening the rowdy sheet against the respondent No.5 even though he is habituated in committing the offences causing breach of peace and public tranquility is arbitrary, illegal and contrary to police standing order No. 601 and consequently direct the respondent No.1 to 3 to open the rowdy sheet against the respondent No.5 in terms of police standing order No. 601 and watch his movements from committing further

offences in the interest of justice.…”

2. Heard Ms.K.Kishanmayee, learned counsel representing Mr.P.Nagendra Reddy, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home

appearing for respondents No.1 to 4.

3. Learned counsel for the petitioner submits that the present writ petition has been filed questioning the inaction of respondent Nos.1 to 3 in not opening a rowdy sheet against respondent Nos.5 and 6, and seeking appropriate directions in that regard.

4. Learned Assistant Government Pleader for Home submits that respondent No.5 was arrayed as an accused in Crime No.187 of 2022. However, during the pendency of the said criminal proceedings, respondent No.5 passed away on 26.12.2022, and consequently, the proceedings stood closed. In view of the said development, it is submitted that nothing further remains in this matter for consideration.

5. I have perused the material placed on record.

6. Having regard to the nature of the relief sought by the petitioner and in view of the undisputed fact that respondent No.5 has since passed away, no adjudication is required in this matter. Accordingly, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
