O R D E R :
With the consent of both the parties, this Writ Petition is
taken up for disposal at the admission stage itself.
2. This Writ Petition is filed, under Article 226 of the
Constitution of India, seeking the following relief:
“…to issue of a Writ, Order or Direction, more particularly one in the
nature of WRIT OF MANDAMUS, declaring the Proceedings in Memo No.1376/SCD.Vig/2021, dated 02.09.2025 issued by the 1st Respondent herein despite of the order dated 06.12.2024 passed by this Hon’ble Court in W.P.No.34358 of 2024 and furnishing of
Indemnity Bond submitted by the Writ Petitioner in respect of the payment of the 80% of the Eligible Retirement Gratuity and Encashment of Earned Leaves for a period of 300 days and criminal charges not framed by the competent criminal court till today / disciplinary proceedings not yet conducted after elapsed nearly 6 years and also not in progress and pending before the competent criminal court as void, illegal, arbitrary and unconstitutional and contrary to A.P. Revised Pension Rules and violation of Articles 14, 21 and 300-A of the Constitution of India and set aside the same and consequently direct the Respondents to release the 80% of Retirement Gratuity and Encashment of Earned Leaves for 300 days as per Rule 52 (c) of T S Revised Pension Rules as per Clause 3 (B) (C) and (D) of G O Rt.No 1097, dated 22.06.2000 and my eligibility by following the order dated 17.02.2025 passed by the Hon’ble Division Bench of this Hon’ble Court in W.P.No.38800 of 2012 and W.P.No.15640 of 2024 and when same reliefs have been extended to similarly situated persons who were worked in one and very same department vide G.O.Rt.No.165, SCD (Vig) Dept., dated 16.05.2025 and pass…”
3. Heard Sri R.Prabhakar, learned counsel for the petitioner; learned Government Pleader for Services-III for respondent Nos.1 to 3, 5 and 6; and Sri K.Bala Krishna, learned Standing Counsel for Accountant General, for respondent No.4.
4. Learned counsel for the petitioner submitted that in similar circumstances, this Court in W.P. Nos.30443 of 2016, 13353 of 2018, 42419 of 2017, vide orders dated 14.02.2017, 05.01.2023 and 18.08.2023 respectively, had directed the respondents to release 80% of the Retirement Gratuity to the petitioners therein in accordance with G.O.Rt.No.1097 dated 22.06.2000. Therefore, learned counsel seeks similar relief in this Writ Petition also.
5. Learned Government Pleader as well as learned Standing Counsel appearing for the respondents submitted that the respondents will consider the said request of the petitioner in accordance with G.O.Rt.No.1097, dated 22.06.2000.

In view of the submissions made by the learned counsel for the respective parties and having regard to the facts and circumstances of the case, the Writ Petition is disposed of with a direction to the respondents to pay retirement gratuity to the petitioner as per Rule 52 (c) of the T.S. Revised Pension Rules and G.O.Rt.No.1097, dated 22.06.2000 subject to petitioner furnishing indemnity bond to the respondents within a period of four (04)
weeks from the date of receipt of a copy of this order.
Miscellaneous petitions pending, if any, shall stand closed.
There shall be no order as to costs.
