O R D E R :

With the consent of both the parties, this Writ Petition is

taken up for disposal at the admission stage itself.

2. This Writ Petition is filed, under Article 226 of the

Constitution of India, seeking the following relief:

“…to issue a writ in the nature of Mandamus or any other

appropriate writ order or direction by declaring the action of respondents is not considering the case of the petitioner for promotion as Additional Assistant Engineer on the sole ground of pendency of CC No.8/2024 (FIR No.13/RCT-RRR/2020, dt.18-11-2020), on the file of the court of Hon’ble 1st Additional Special Judge for SPE & ACB case at Hyderabad though he is entitled to be consider for such

promotion in terms of 3(B)(i)&(ii) of APSEB Service Regulation part-III as adopted by TGSPDCL, as illegal arbitrary and unconstitutional being violative of Article 14, 16 & 21 of Constitution of India and also contrary to the orders of Hon’ble court and consequently direct the respondents to consider the case of petitioner for promotion to the post of Additional Assistant Engineer in terms of Regulations 3(B)(i)&(ii) of APSEB Service Regulation part-III as adopted by TGSPDCL and also in terms of G.O. Ms. No.257, GA(Services-C) Dept., dt. 10-06-1999, without reference to CC No.8/2024 (FIR No.13/RCT- RRR/2020, dt.18-11-2020), on the file of the court of the Hon’ble 1^st Additional Special Judge for SPE & ACB case at Hyderabad, with all consequential benefits., and to pass…”

3. Heard Sri S.Ajay Kumar, learned counsel for the petitioner; Sri N.Sreedhar Reddy, learned Standing Counsel for Telangana State Power Distribution Company Limited, for respondent Nos.1 and 2; and learned Government Pleader for Services-II for respondent No.3.

4. Learned counsel for the petitioner submits that while the petitioner was working as Sub-Engineer O/o. Divisional Engineer, Keesara, a case in FIR No.13/RCT-RRR/2020 on the file of Anti- Corruption Bureau, Ranga Reddy Range, Hyderabad, was registered against him on 17.11.2020 and after filing of the charge sheet, the case was numbered as C.C. No.8 of 2024 on the file of learned I Additional Special Judge for SPE & ACB Cases at Hyderabad. It is further submitted that though the petitioner is eligible for further promotion to the post of Additional Assistant Engineer, the respondents are not considering his candidature on the ground of pendency of aforesaid criminal case. It is also submitted that the government issued guidelines in G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999, to consider the cases of employees for promotion against whom disciplinary proceedings/criminal proceedings are pending. Therefore, learned counsel prays this Court to direct the respondents to consider the case of the petitioner for promotion to the post of Additional Assistant Engineer, in terms of G.O.Ms.No.257 dated 10.06.1999.

5. Learned Standing Counsel appearing for respondent Nos.1 and 2 submits that since the petitioner was involved in a criminal case, he is not eligible for promotion to the post of Additional Assistant Engineer.

Having regard to the submissions made by learned counsel for the respective parties and as the criminal case registered against the petitioner is pending since 2020, this Court is of the view that it would be appropriate to direct the respondents to consider the case of the petitioner for promotion to the post of Additional Assistant Engineer in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999, as and when promotions takes place.

7. With the above direction, this Writ Petition is disposed of.
