O R D E R

In this Writ Petition, the petitioner is challenging the action of respondent No.4 Returning Officer in allowing the application/ nomination of respondent No.6 ignoring the representations of the petitioner dt.04.12.2025 and 05.12.2025 with regard to the age of respondent No.6 who is contesting for Ward No.2 in Chinna Kodpgal of Gram Panchayat, as illegal and arbitrary.

Learned counsel for the petitioner submits that respondent No.6 has not completed the age of 21 as per her 10^th class certificate and therefore, she is not eligible for contesting in the elections. He submits that the petitioner has also approached the Returning Officer on 03.12.2025, however, her objection was not considered and therefore she has made written representations on 04.12.2025 as well as on 05.12.2025, but the same were not considered and respondent No.6 is allowed to contest the election and that the petitioner is also one of the contesting candidates in the subject election.

Learned Government Pleader for Panchayat Raj has obtained instructions in writing from the Deputy District Election Authority and Sub-Collector, Banswada, Kamareddy District, who submitted that the petitioner’s representations were received on 04.12.2025 and 05.12.2025 after the scrutiny of the nominations concluded on 03.12.2025. It is further submitted that respondent No.6 has submitted her age-related declarations supported by her electoral photo identity card, PAN Card and Aadhaar Card and there is no material indicating any prima facie or apparent disqualification which was produced before the Returning Officer at the time of scrutiny and therefore, her nomination has been accepted.

Upon hearing both parties, this Court finds from the schedule of election that the election of the concerned village is to be held in the second phase and the date of scrutiny of nominations was 03.12.2025 up to 5.00 PM. The petitioner has not submitted any written objections before the authorities on 03.12.2025 and the evidence produced before this Court is only her representations on 04.12.2025 and 05.12.2025, i.e., after the date of scrutiny of nominations. Therefore, at this stage, this Court is not inclined to interfere with the process of election. However, the petitioner is at liberty to raise her objection in an election dispute if respondent No.6 succeeds in the election.

5. The Writ Petition is accordingly dismissed. No order as to costs.

6. Pending miscellaneous petitions, if any, in this Writ Petition shall also stand dismissed.
