ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“...pleased to issue an appropriate Writ, order or direction more particularly one in the. nature of Writ of Mandamus declaring the action of the 4th respondent in interfering with peaceful possession and enjoyment of petitioners lands i.e. an extent Ac.01-00 extent of 00-20 Guntas, extent of Ac.00-10 Guntas, extent of 00-10 Guntas totally admeasuring Ac.02-00 out of Ac.03-00, in Survey No.51/8 and 52/8, situated at Bahadurguda Village and Gram Panchayath, Shamshabad Mandal, Ranga Reddy District, without following due process of law as being illegal, arbitrary and against to principles of natural justice and Art.300A of the Constitution of India, 1950 and consequently direct the 4th respondent not to interfere with peaceful possession and enjoyment of petitioners lands without following due process of law and to pass...”

2. Heard Sri Shashidhar Guruvula, learned counsel for the petitioners and Sri L.Ravinder, learned Assistant Government Pleader for Revenue, for the respondents and perused the record.

Learned counsel appearing for the petitioners would submit that the petitioner had purchased the land to an extent of Ac.1.00 guntas in Sy.No.51/8 and 52/8, Ac.0.20 guntas, Ac.0.10 guntas, Ac.0.10 guntas out of Acs.3.00 guntas, total admeasuring Ac.2.00guntas, situated at Bahadurguda Village and Gram Panchayath Shamshabad Mandal, Ranga Reddy District, having acquired the same from their predecessor through a registered sale deed bearing document No.8991 of 2007, dated 26.12.2007.

Originally the subject lands belongs to one Smt.Lateefunnisa Begum and upon her demise, her successors have filed O.S.No.4788 of 2006 on the file of the learned VIII Junior Civil Judge, City Civil Court, Hyderabad seeking succession. Accordingly, the said Suit was decreed in their favour on 10.11.2006. As such, they were declared as true successors of Smt.Lateefunnisa Begum. Thereupon, the said successors have executed registered GPA in favour of third parties, from whom the subject land was purchased through registered sale deed.

While the things stood, the Tahsildar, Shamshabad Mandal, Ranga Reddy District vide Lr.No.A1/1965/2000, dated 08.02.2006 addressed a letter to the Assistant Director S and LRS Ranga Reddy District stating that as per the endorsement of the Collector Ranga Reddy District dated 26.12.2005 he is enclosing the list of occupants in the private lands of Bahdurguda Village and requested to prepare and issue pattedar passbook/title deed to the Ryot for the patta lands and also requested to update the pahani as per the list enclosed and the same was also communicated to the District Collector Ranga Reddy District and the Revenue Divisional Officer, Chevella Division. Thereafter, respondent No.4 vide L.No.B/1604/2017, dated 23.09.2017 has written to Sub-Registrar, Shamshabad directing respondent No.2 for cancellation of certain registered sale deeds. Basing on the said letter, Sub- Registrar, Shamshabad has executed cancellation deeds stating that the land in Sy.Nos.28 and 62 were belonging to government only and the same is nothing to do with the petitioners lands. The said act was done without any authority, and behind the back and without any right or title in favour of the Government.

5. In the counter filed by respondent No.4 in W.P.No.36478 of 2017, it is stated that, it is true that Smt.Lateefunnisa Begum was pattedar of said land and other lands. The lands to an extent of Acs.650.00 guntas in Sy.Nos.28 and 62 belongs to government as same are ceiling surplus lands. Later, on 20.09.
