ORDER:
This Writ Petition is filed challenging the order dated
18.03.2024 in C.G.No.283/2023-24/Medchal Circle on the file of the 3rd respondent and seeks to quash the same.
2. Heard Sri N.Sreedhar Reddy, learned Standing Counsel for TSSPDCL, for the petitioners and Ms.Sai Mahitha, learned counsel for respondent Nos.1 and 2. Perused the record.
3. When the matter is taken up for hearing, learned counsel for the respondent Nos.1 and 2 submitted that the issue raised in this Writ Petition is squarely covered by the common order passed by this Court in W.P.Nos.29779 and 21044 of 2024, dated 17th July, 2025 and therefore, the same order may be passed in this writ petition as well. The operative portion of the said order reads as under:
“4. Learned Standing Counsel submits that the Consumer Grievances Redressal Forum was constituted by Chairperson (FAC), Member Technical and Member Finance; Smt.B.Lalitha is Chairperson (FAC) and Member Technical. It is submitted that the impugned order was signed by Chairperson (FA) and Member Technical who is one and the same and dissenting view was expressed by Member Finance. Since there is no majority opinion, learned Standing Counsel requests this Court to remand the matter to the said forum to examine the matter afresh.
5. Considering the said submissions, the order dated 22.01.2024 in C.G.No.212/2023- 24/Rajendranagar Circle is quashed and the matter is remanded to the 2nd respondent to examine the issue afresh and pass appropriate orders as expeditiously as possible. W.P.No.21044 of 2024 is allowed accordingly.”
4. Accordingly, in terms of the common order passed by this Court in W.P.Nos.29779 and 21044 of 2024, dated 17th July, 2025 and for the reasons alike, this Writ Petition is allowed. The order dated 18.03.2024 in C.G.No.283/2023-24/Medchal Circle is quashed and the matter is remanded to the 3rd respondent to examine the issue afresh and pass appropriate orders as expeditiously as possible. No costs.
Pending miscellaneous applications, if any, shall stand closed.
