ORDER:

This Contempt Case is filed alleging wilful disobedience of the order dated 03.07.2025 passed by this Court in W.P. No. 7289 of 2018, wherein the Writ Petition was allowed and the rejection of the petitioner’s candidature for the post of Trained Graduate Teacher (Physical Science/Science) under Notification No.14/2017 was set aside.

2. Heard Ms. Vedula Chitralekha, learned counsel for the petitioner and Sri P.S. Rajasekhar, learned Standing Counsel for Telangana State Public Service Commission (TGPSC), for the respondent.

Learned counsel for the petitioner contends that despite the clear directions issued by this Court in order dated 03.07.2025 and despite representations dated 06.08.2025 and legal notice dated 18.08.2025, the respondent failed to issue an allotment order to the petitioner. She submits that such inaction on the part of the respondent amounts to wilful and deliberate disobedience of the order passed by this Court, attracting the provisions of the Contempt of Courts Act, 1971.

4. Learned Standing Counsel for TGPSC filed a detailed counter affidavit denying wilful disobedience. He submits that in compliance with the interim order dated 06.03.2018 in the Writ Petition, posts were kept vacant. He submits that after the final order dated 03.07.2025 passed in the Writ Petition, the issue of eligibility of candidates possessing 5-year Integrated M.Sc. Chemistry qualification was reconsidered. He submits that after due deliberation, the TGPSC resolved in its meeting dated 02.09.2025 to comply the order dated 03.07.2025. He submits that the petitioner was considered eligible and brought within the zone of selection. He further submits that there was no intentional or deliberate violation of the Court’s order by the respondent.

5. This Court has considered the rival submissions and perused the material placed on record. The respondent has filed a counter-affidavit detailing the steps taken for compliance of the order dated 03.07.2025 in the Writ Petition, including keeping the posts vacant in terms of the interim order, referring the issue of qualifications to expert examination, and passing a resolution of the Commission on 02.09.2025 to select the petitioner in accordance with the directions of the writ court, taking into account her relinquishment of the post of TGT-Science. The explanation offered by the respondent shows that the delay was procedural and not intentional. In contempt jurisdiction, the Court is required to examine whether there is wilful and deliberate disobedience of its orders. In the present case, the material on record does not establish such wilful disobedience on the part of the respondent.

6. In view of the above facts and circumstances, this Court is satisfied that the respondent has complied with the order dated 03.07.2025 passed in W.P. No. 7289 of 2018. Accordingly, the Contempt Case is closed. No costs.

Pending miscellaneous applications, if any, shall stand closed.
