This transfer criminal petition is filed praying this Court to transfer DVC.No.60 of 2021 pending on the file of the III Additional Judicial Magistrate of First Class (PCR) at Karimnagar, to the file of competent Court at Ranga Reddy District, LB.Nagar.

2. Heard Sri K.Uday Kumar, learned counsel for petitioner, and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for respondent No.1 – State. As notice was not served upon respondent No.2, upon directions by this Court, notice was served upon counsel on record before trial Court on 15.11.2025. In spite of same, none appeared for respondent No.2, as such, notice is deemed to be served.

Learned counsel for the petitioner submitted that the petitioner is the legally wedded wife of respondent No.2, and when disputes arose between them, the petitioner herein filed DVC.No.60 of 2021 before the III Additional Judicial Magistrate of First Class (PCR) at Karimnagar as during that time she resided at Karimnagar. He contended that the respondent No.2/husband filed FCOP.No.167 of 2023 for dissolution of marriage before the II Additional Family Court, at Ranga Reddy District, and the same is pending adjudication. Therefore, while averring that petitioner is now residing in Hyderabad, he prayed this Court to allow this transfer criminal petition for convenience of both parties.

Having regard to the submissions made by learned counsel for petitioner, and on going through the material placed on record, it is noted that this transfer petition is filed to transfer DVC., filed by petitioner herein, on the ground that she is no longer residing in Karimnagar, and FCOP filed by respondent No.2 is already pending before Family Court at Ranga Reddy District. Therefore, this Court is of the opinion that sufficient grounds are made out to allow this transfer criminal petition.

5. Accordingly, this Transfer Criminal Petition is allowed, and DVC.No.60 of 2021 pending on the file of the III Additional Judicial Magistrate of First Class (PCR) at Karimnagar, to the file of the II Additional Family Court, at Ranga Reddy District, LB.Nagar. The Court concerned is hereby directed to transmit the entire case file relating to DVC.No.60 of 2021 after duly indexed, within a period of one (1) month from the date of receipt of a copy of this order, under the due intimation of the same to the other side.

Miscellaneous applications, if any pending, shall stand closed.
