ORDER

This Criminal Revision Case is filed aggrieved by the order dated 23.12.2022 passed in Crl.M.P.No.217 of 2014 in C.C.No.1 of 2014 by the learned Principal Special Judge for Trial of SPE & ACB cases, Hyderabad, wherein the petitioner filed the discharge petition under Section 239 of the Code of Criminal Procedure, 1973 and the same was dismissed by the trial Court.

2. Heard Sri E. Venkata Siddhartha, learned counsel for the petitioner and Sri T. Bala Mohan Reddy, learned Standing Counsel for ACB for the respondent. Perused the record.

3. Learned Standing Counsel appearing for the respondent while arguing the matter, informed this Court that the charge has already been framed and that the trial in C.C.No.1 of 2014 has commenced, the next step being issuance of summons to the victim.

4. Learned counsel for the petitioner submitted that, in view of the fact that the trial has already commenced, this Court may record its observation that the arguments advanced in the discharge petition may still be raised before the trial Court during the course of trial.

5. In view of the rival submissions made by both the learned counsel and a perusal of the material available on record, it appears that the trial has already commenced. It is the specific contention of the learned Standing Counsel that the charges are framed and the trial has commenced. However, it is the specific contention of the learned counsel for the petitioner that since the trial has commenced, the arguments which are advanced by the learned counsel for the petitioner before the trial Court, may be considered during the course of trial.

6. In view thereof, this Criminal Revision Case is disposed of with a liberty to raise the petitioner’s contentions before the trial Court, which are advanced in the discharge petition. Further, as the C.C. pertains to the year 2014, the trial Court is directed to dispose of the same, as expeditiously as possible and both the parties are directed to co-operate with the trial.

Miscellaneous applications, if any pending, shall also stand closed.
