Heard Mr. N. Krishna Sumanth, learned counsel for the petitioner and Sri Srinivas Velagapudi, learned counsel for the respondent.

This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Civil Procedure Code seeking transfer of F.C.O.P.No.578 of 2020 pending on the file of the learned Judge, Additional Family Court at Rangareddy District at L.B.Nagar to the file of the learned Senior Civil Judge at Nalgonda, to be tried along with O.P.No.109 of 2020.

3. Learned counsel for the petitioner submitted that petitioner-wife is a resident of Narketpally, and the same is evident from the cause title in F.C.O.P No.578 of 2020. Further, the petitioner is living with her parents and is dependent on them for her maintenance. She filed O.P.No.109 of 2020 seeking restitution of conjugal rights and the said O.P. is currently at the stage of commencement of trial after framing of issues. Learned counsel further submitted that transfer is necessary in order to avoid conflicting judgments by two different Courts.

4. In support of his contention, learned counsel for the petitioner relied upon the judgment of the Hon’ble Supreme Court in N.C.V. Aishwarya vs. A.S. Saravana Karthik Sha1 wherein, the petitioner-wife was residing at Vellore and the respondent-husband was residing at Chennai and considering the age, dependency of the wife and the distance between the

places, allowed the Tr.C.M.P. in favour of the petitioner-wife therein.

5. Learned counsel for the respondent opposed the transfer by filing counter. Firstly, learned counsel submitted that F.C.O.P No. 578 of 2020 is at the stage of cross–examination of RW-2, who is father of the petitioner herein. The petitioner was already examined as RW-1 and once the cross- examination of RW-2 is completed, the said F.C.O.P No.578 of 2020 would be posted for final arguments, whereas, trial is yet to be commenced in O.P.No.109 of 2020 filed by the petitioner- wife. Secondly, learned counsel submitted that the son of the petitioner is admitted in a School at Hayatnagar, Khalsa Branch, and in proof thereof, photographs and admission receipts are produced. The said photographs and admission receipts show that the child Ramidi Anirudh Reddy is admitted in Sri Chaitanya Techno School at Hayatnagar. Lastly, the respondent produced a copy of the complaint lodged with the Circle Inspector, Nalgonda 1 Town Police Station, dated 03.12.2025, wherein it is stated that the petitioner herein, after hearing the M.C. case, has broken the car glass with a stone. In view of this incident, the respondent apprehends with respect to his safety for attending the Courts at Nalgonda. 6. As seen from the record, it is noticed that the petitioner herein is aged 31 years and is a house wife, depending upon her parents. However, she is attending F.C.O.P.No.578 of 2020, pending on the file of the learned Judge, Additional Family Court, Ranga Reddy District at L.B. Nagar, for the past five years and currently, the matter is at the stage of cross examination of RW-2. Further, the photographs and the admission receipts show that the son of the petitioner is living at Hayatnagar, Khalsa and attending the school for the purpose of speech therapy. Further, in the complaint filed before the Nalgonda 1 Town Police Station, it is alleged that the petitioner broken the car glass with a stone, which itself shows the violent behavior of the petitioner.

7. In view of the foregoing circumstances, since F.C.O.P.No.578 of 2020 is at the fag end of trial, this Court finds no reason to transfer F.C.O.P.No.578 of 2020, at this juncture. The question of conflicting decisions does not arise when once F.C.O.P.No.578 of 2020 is disposed of, the same will have a bearing on the O.P. filed b
