WP 36136/2025
IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SMT. JUSTICE T. MADHAVI DEVI WRIT PETITION NO.36136 OF 2025 DATED : 04.12.2025 Between:
Duppati Sambaiah ... Petitioner AND The State of Telangana rep. by its Principal Secretary, Civil Supplies Department and 3 others ... Respondents
O R D E R
In this Writ Petition, the petitioner is seeking a Writ of Mandamus declaring the action of the 2nd respondent in not considering his representation dt.27.10.2025 as illegal and arbitrary and consequently to direct the 2nd respondent to consider and dispose of his representation dt.27.10.2025 forthwith and to pass such other order or orders.
2. In the representation dt.27.10.2025, the petitioner is aggrieved by handing over of Fair Shop No.2157027 to another dealer by name Bochu Renuka, W/o late Prakash @ Saraiah. The petitioner claims that he was in-charge of the said shop from the year 2019 and he was removed by order dt.14.10.2025 and it is stated that the ration shops are his livelihood and he has been supporting his family only through them. 3. Learned Government Pleader for Civil Supplies has forwarded a copy of the letter addressed by the Tahsildar, Parkal to the Revenue Divisional Officer, Hanumakonda stating that Shop Nos.2159027 and 2159028 were under the control of the petitioner. He submitted that the petitioner was the Fair Price Shop dealer for Shop No.2159028 and was in-charge dealer for Shop No.2159027 and the petitioner is still continuing as dealer of Shop No.2159028 and that there is no illegality in the order dt.14.10.2025.
4. Learned Counsel for the petitioner submitted that it is only on the instructions of a local politician that the in-charge shop has been removed from him.
5. However, on going through the order dt.14.10.2025 of the 4th respondent, this Court finds that the in-charge Shop No.2159027 has been handed over to Bochu Renuka, W/o late Prakash @ Saraiah. It is also mentioned therein that the petitioner, who was managing the Fair Price Shop No.2159028 as its regular dealer, is relieved from his duties as in-charge dealer of Fair Price Shop No.2159027. Therefore, it appears that the petitioner’s in-charge shop only has been removed.
6. The respondents are therefore directed to consider the representation of the petitioner dt.27.10.2025 and to pass appropriate orders thereon in accordance with law expeditiously.
7. With the above direction, the Writ Petition is disposed of. No order as to costs.
8. Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed.
