ORDER:

This writ petition is filed seeking following relief:

“…to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd Respondent in not permitting the petitioner to appear for the examinations for Phase-II and Phase-III MBBS Course, for completing his course in terms of the Regulations on Graduate Medical Education, 1997 issued by the 3rd respondent, by considering the representation submitted by the petitioner in the month of February, 2013, as illegal, arbitrary and violative of Article 14 of the Constitution of Iridia apart from being violative of Principles of natural justice and consequently set aside the proceedings of the 2nd respondent in Reference No.1770/MBBS/BDS/RA/EA1/2012, dated 29-08-2012 being illegal by declaring that the re-admission regulations issued by the 2nd respondent in the year 2012-13 are not applicable to the petitioner and direct the Respondents No.1 and 4 to permit the petitioner to appear for the examinations of backlog subjects of Phase-II and Phase-III of MBBS Course and to permit him to complete the course in terms of the Regulations...”

2. Sri Papaiah Peddakula, learned Counsel, representing Sri Sai Charan Telaprolu, learned Counsel for the petitioners on record as well as learned Assistant Government Pleader for Higher Education present.

3. Learned Counsel for the petitioners would submit that the cause in the present Writ Petition does not survive for adjudication and it has become infructuous.

4. Recording the above submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
