ORDER:

Heard Sri K.Vijaya Bhaskar Reddy, learned counsel for the petitioners, Smt S. Sravanthi, learned Assistant Government Pleader for Revenue and Sri Bajrang Singh Thakur, learned counsel for the respondent No.4.

2. This writ petition is filed questioning the order bearing No.D1/42/RDO/VKB/SPL.TBL2021.C/1705/ 2018-(VKB) dated 21.01.2021 passed by the respondent No.2 as illegal and arbitrary.

Learned Counsel for the petitioners submits that without giving opportunity to the petitioners, the respondent No.2-Special Tribunal has passed the impugned order on 21.01.2021 and the same is contrary to the orders of this Court in W.P.(PIL).No.20 of 2021 dated 18.03.2021 and the impugned order has to be set aside and remand the matter to the competent authority.

On the other hand, learned counsel for the respondent No.4 submits that the Tahsildar, Pudur Mandal has passed the order without conducting enquiry and without issuing notice to the respondent No.4 being legal heir of late Bheemaiah and the respondent No.2-Special Tribunal has rightly set aside order passed by the Tahsildar directing the parties to file fresh petition along with documentary evidence showing their relationship with the pattadar so as to grant succession in their favour basing on the records and enquiry and without doing the same, the petitioners filed the present writ petition. He further submits that the Tahsildar has to conduct fresh enquiry by issuing notice to the petitioners as well as the respondent No.4 as per the procedure for issuing pattadar passbooks.

In view of the aforesaid submissions, the Writ Petition is disposed of by setting aside the order bearing No. No.D1/42/RDO/VKB/SPL.TBL2021.C/1705/ 2018-(VKB) datedc 21.01.2021 passed by the respondent No.2-Special Tribunal and the matter is remanded to the Tahsildar, Pudur Mandal for conducting denova enquiry after issuing notice and opportunity to the petitioners and the respondent No.4 including their personal appearance and pass orders under Telangana Bhu Bharathi (Record of Rights in Land) Act, 2025 as expeditiously as possible within three months from the date of receipt of a copy of this order. Till passing of the orders by the Tahsildar, Pudur, both the parties are directed to maintain status quo existing as on today in all aspects. No order as to costs.

6. Miscellaneous applications pending, if any in this writ petition, shall stand closed.
