ORDER :

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“…to issue Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent Nos. 2 and 3 in not taking any action on the representations submitted by the Petitioners regarding the non implementation of the 2016 AICTE Pay Scales, Non-implementation of the increased Dearness Allowance and Non-payment of salaries, by the Respondent No.5 College, as illegal, arbitrary and unconstitutional for violating Article 14 and 21 of the Constitution of India, 1950 and consequently direct the Respondent Nos. 2 and 3 to take action against the Respondent No.5 College for non-implementation of the 2016 AICTE Pay Scales, Non-payment of Dearness Allowance, Non-payment of the salaries to the petitioners and pass…”

2. Heard Sri Saini Aravind, learned counsel for the petitioners and learned Government Pleader for Services – I appearing for respondent Nos.1 & 2, Sri M. Mehboob Ali, learned Standing Counsel for AICTE, appearing for respondent No.3 and Sri Sai Prasen Gundavaram, learned Standing Counsel for Institute of Engineering and Technology appearing for respondent Nos.4 to 6. With their consent, this Writ Petition is taken up for disposal at the admission stage.

Learned counsel for the petitioners submits that while the petitioners are working as Lecturers in respondent No.5 College, they made a representation to respondent No.6 on 09.02.2023, requesting resolution of their grievance, pertaining to payment of Dearness Allowance/Increment Arrears and implementation of Revised AICTE Pay Scales 2016. However, no action has been taken thereon, so far. Therefore, learned counsel prays this Court to direct respondent No.6 to consider the petitioner’s representation dated 09.02.2023 and pass necessary orders within a time-frame as may be stipulated by this Court.

4. Learned Government Pleader appearing for the respondents fairly submits that respondent No.6 will consider the representation of the petitioners dated 09.02.2023 and pass appropriate orders in accordance with law.

5. Having regard to the submissions made by learned counsel for the respective parties, without going into merits of the case, this Writ Petition is disposed of, directing respondent No.6 to consider the representation of the petitioners dated 09.02.2023, and pass appropriate orders thereon, strictly in accordance with law, as expeditiously as possible, preferably within a period of two (02) months from the date of receipt of a copy of this order and communicate a copy thereof the petitioners.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
