IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.36651 OF 2025 DATE OF ORDER: 02.12.2025 Between:
Gopi Pagidimarri ...Petitioner AND The State of Telangana Represented by its Principal Secretary Municipal Administration, & GAD (Department), Secretariat, Hyderabad and two others ...Respondents ORDER : (ORAL)
This writ petition is filed by the petitioner seeking to declare the inaction of respondent No.2 in considering his representation dated 26.11.2025 for removing the encroachment of public road made by respondent No.3 in Annavaram Satyanaran Swamy Nagar Colony, situated in Survey No.186, Nadergull, Badangpet Municipality, Ranga Reddy District, as being illegal, arbitrary and unconstitutional.
2. Heard Ms. G.V.S.S.Sruthi, learned counsel for the petitioner; Mr. Raparthi Venkatesh, learned Standing Counsel for GHMC, appearing for respondent No.2; and perused the material on record.
3. It is stated that the petitioner owns Plot No.25 in Annavaram Satyanaran Swamy Nagar Colony Welfare Association having purchased the same under registered sale deed bearing document No.8796 of 2025 dated 29.08.2025; respondent No.3 is the owner of the neighbouring plot. It is further stated that respondent No.3 entered into partition deed with his family members and got allotted plot number by way of internal arrangements; the plot number was allotted for the sake of convenience. The plot in possession of respondent No.3 forms part of Annavaram Satyanaran Swamy Nagar Colony and abutting to 30 feet public road which is on the northern side of the plot of respondent No.3. However, respondent No.3, by falsely claiming that 30 feet road forms part of his plot, started digging pits on 22.11.2025 by encroaching the road without any valid permission from the competent authorities. Aggrieved thereby, the petitioner submitted representation dated 26.11.2025 to respondent No.2 to take action against respondent No.3 for encroaching public road. On receipt of the representation/complaint of the petitioner, respondent No.2 and staff visited the site of respondent No.3, however, no action has been initiated. As such, the petitioner is constrained to approach this Court.
4. Learned Standing Counsel for GHMC submitted that appropriate action will be taken on the representation/complaint of the petitioner in accordance with law.
5. Recording the aforesaid submission, this writ petition is disposed of directing respondent No.2 to consider the representation of the petitioner dated 26.11.2025 for removing the encroachment of public road made by respondent No.3 in Annavaram Satyanaran Swamy Nagar Colony, situated in Survey No.186, Nadergull, Badangpet Municipality, Ranga Reddy District, by giving opportunity of hearing to the petitioner and respondent No.3, and pass appropriate orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
6. As the order is passed without entering into the merits of the case, notice to respondent No.3 is dispensed with. However if, respondent No.3 is, in any way, aggrieved by this order, he is at liberty to approach this Court seeking for modification of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending in this writ petition, stand closed.
