O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of 1^st respondent in not taking steps under Sec. 91 Cr.P.C. to secure C.C.footage from the Kismath Pub of respondent No.5 Hotel between 8.45 PM to 12.00 PM on 22-03-2018, which covers the movements of the son of the petitioner and allowing respondent No.5 to disappear the piece of evidence as arbitrary and illegal and consequently direct the respondents to secure the C.C. footage from the Kismath Pub of Respondent No.5 between 8.45 PM to 12.00 PM on 22-03-2018, which covers the movements of deceased son of the petitioner forthwith in the interest of justice and to pass…”

2. Heard Mr. P.Nagendra Reddy, learned counsel for the petitioner; Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4 and Mr. B.Chandrasen Reddy, learned counsel appearing for respondent No. 5.

Learned counsel for the petitioner submits that the present writ petition has been filed seeking a direction to respondent No. 1 to secure the CCTV footage from “Kismath Pub,” located within the premises of the 5th respondent’s hotel, for the period between 8:45 PM and 12:00 midnight on 22.03.2018. It is fairly submitted that, pursuant to the representation made by the learned Assistant Government Pleader for Home, the said CCTV footage was supplied by “Kismath Pub” and copied onto a pen drive provided by the petitioner on 30.04.2018. However, as the petitioner has not received formal confirmation regarding the authenticity or completeness of the footage, learned counsel prays for passing of appropriate orders by this Court.

4. Learned Assistant Government Pleader for Home, on written instructions, submits that the CCTV footage requested by the petitioner was duly obtained in a Compact Disk from respondent No. 5, and the same was furnished to the complainant on

25.03.2018. Hence, it is submitted that the relief sought in the writ petition no longer survives for consideration.

Learned counsel appearing for respondent No. 5 submits that, in compliance with the request of the investigating authorities, the CCTV footage covering the period between 8:45 PM and 12:00 midnight on 22.03.2018 was duly furnished to the concerned police. Accordingly, it is contended that the petition has become infructuous, and prayed that the same be dismissed.

6. I have perused the material available on record.

7. The specific prayer of the petitioner is to secure the CCTV footage recorded on 22.03.2018 between 8:45 PM and 12:00 midnight from the premises of the 5th respondent. The submissions made by the learned Assistant Government Pleader for Home, supported by the statement of the learned counsel for respondent No. 5, clearly indicate that the CCTV footage sought by the petitioner has already been obtained by the investigating authorities and a copy thereof has been furnished to the petitioner.

8. In light of these developments, the primary relief sought in this writ petition stands satisfied. Accordingly, this Court is of the considered view that nothing further remains for adjudication in this matter.

9. With the above observations, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
