O R D E R:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents 2 and 3 in executing the Non-Bailable Warrants of Arrest against the accused K.Hari Babu and K.Padmaja Rani as issued by Hon’ble I Special Metropolitan Magistrate Court, Kukatpally in C.C.No.368 of 2013 and III Special Metropolitan Magistrate Court, Kukatpally, Miyapur in C.C.No.482 and 486 of 2015 as bad, arbitrary and capricious with a consequential direction against the respondents 2 and 3 to complete the process of execution of pending Non-Bailable Warrants against the accused K.Hari Babu and K.Padmaja Rani as directed by Hon’ble I Special Metropolitan Magistrate Court, Kukatpally in C.C.No.368 of 2013 and III Special Metropolitan Magistrate Court, Kukatpally, Miyapur in C.C.No.482 and 486 of 2015 and to pass…”
2. None appears for the petitioner. Heard Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for the respondents.
the petitioner’s contention pertains to the alleged failure of the respondent police authorities to execute Non-Bailable Warrants (NBWs) issued against the accused persons in C.C. No. 368 of 2013 on the file of the I Special Metropolitan Magistrate Court, Kukatpally, and in C.C. Nos. 482 and 486 of 2015 on the file of the III Special Metropolitan Magistrate Court, Kukatpally.
3.2. It is further submitted that, as per the written instructions received from the concerned police authorities, the Non-Bailable Warrants in the aforesaid cases were duly executed on 10.10.2018, and the warranted accused were produced before the respective Courts. Accordingly, the learned Government Pleader contends that the grievance raised by the petitioner no longer survives for consideration.
4. I have perused the material available on record.
5. The prayer of the petitioner is for a direction to the respondent police authorities to execute the Non-Bailable Warrants issued in the aforementioned calendar cases. In view of the submission made by already been executed on 10.10.2018, and the accused persons have been presented before the concerned Courts, it is evident that the grievance of the petitioner has been effectively redressed.
6. In the light of the above factual position, this Court finds that nothing further remains for adjudication in the present matter.
7. Accordingly, this writ petition is dismissed as infructuous. There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
