O R D E R:

“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, directing the illegal interference of respondent Nos.2 and 3 into the petitioner’s (1) Land admeasuring Ac. 0-39 Gs., in Sy.No. 16/Aa/1, (2) Land admeasuring Ac. 0-39.5 Gs., in Sy.No. 16/Aa/2, (3) Land admeasuring Ac. 0-39.5 Gs., in Sy.No. 16/Aa/3, (4) Land admeasuring Ac. 1-00 Gs., in Sy.No. 16/Aa/4, totally admeasuring Ac. 3-38 Gts., situated at Aushapur Village and Gram Panchayat, Ghatkesar Mandal, Medchal Malkajgiri District at the behest of respondent No. 4 as illegal, unjust, and against rule of law and violative of Art. 300-A of Constitutional of India and consequently direct the respondents not to interfere into the petitioner’s land and also civil dispute between the petitioner and 4th respondent and pass…”

2. Heard Mr. C.Janardhan, learned counsel representing Mr. P.Vishnuvardhana Reddy, learned counsel appearing for the petitioner and Mr. D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos. 1 to 3.

3. Learned counsel for the petitioner submits that the present writ petition has been filed seeking a direction against respondent Nos. 2 and 3 to refrain from interfering in the petitioner’s landed properties situated at Aushapur Village and Gram Panchayat, Ghatkesar Mandal, Medchal-Malkajgiri District. It is contended that respondent police authorities are illegally interfering in the civil disputes pending between the petitioner and respondent No. 4, and therefore, the petitioner seeks a direction to the respondent police not to interfere in such civil disputes or in the possession of the petitioner’s properties.

4. Learned Assistant Government Pleader for Home submits that the allegations made against the respondent police authorities are unfounded and unsupported by any credible material. It is asserted that the police have not interfered either in the civil disputes between the petitioner and respondent No. 4, or with the possession of the subject properties. The respondent police have been acting strictly in accordance with law and within the limits of their statutory authority. Accordingly, it is prayed that the petition be dismissed.

5. I have perused the material available on record.

6. The petitioner, in his affidavit, has alleged that the respondent police authorities, particularly respondent Nos. 2 and 3, have been interfering in the civil disputes between the petitioner and respondent No. 4, and have also attempted to disturb his possession over the petition schedule properties.

7. Having regard to the submissions made and the settled limitations on police intervention in civil disputes, it is to be reiterated that police authorities are not to involve themselves in matters of purely civil nature, such as disputes concerning title, possession, or ownership of immovable property, except where law and order considerations arise.

8. Accordingly, respondent Nos. 2 and 3 are directed to refrain from interfering in the civil disputes between the petitioner and respondent No. 4, and from disturbing the petitioner’s possession over the petition schedule properties, except in accordance with law and due process.

9. It is, however, clarified that any lawful action taken by the respondent police authorities in discharge of their official duties and in strict conformity with legal procedure shall remain unaffected by this order.

10. With the above directions, the writ petition stands disposed of. There shall be no order as to costs. Miscellaneous Petitions, pending if any, shall stand closed.
