O R D E R:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the action of 3rd respondent in frequently calling the petitioner to the police sit the petitioner in the police station hours together on the guise of enquiry is illegal, arbitrary and in violation of Articles 14, 19 and 21 of theConstitution of India and consequently direct 3rd respondent not to call and not sit in the police station hours together, and pass…”
2. None appeared on behalf of the petitioner.
3. Heard Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3.
4. Learned Assistant Government Pleader for Home submits that the contention of the petitioner is that the respondent police authorities are summoning her without any lawful cause, is unfounded and baseless. It is further asserted that the police have been conducting themselves strictly in accordance with law and within the limits prescribed by statutory provisions. Hence, the allegations made by the petitioner are without substance, and the petition deserves to be dismissed.
5. I have perused the material available on record.
6. Having regard to the grievance of the petitioner and the submissions made by the respondent police authorities, and keeping in view the limitations on police powers even during enquiry or investigation in criminal proceedings, this Court deems it appropriate to direct the respondent police authorities to refrain from interfering with the petitioner’s personal life and liberty and not to summon her to the police station without any tenable and justifiable reasons. However, it is made clear that any action taken by the respondent police authorities strictly in accordance with law and following due procedure shall remain unaffected.
7. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
