IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE N.TUKARAMJI
A. Radhika – Appellant
Versus
The State of Telangana – Respondent
WP 27109/2017

ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:

“…to pass an order(s) or direction(s) more particularly one in nature of Writ of Mandamus in declaring the inaction of 2nd and 3rd Respondent in considering petitioners representation dated 26-7-2017 against the 4th Respondent in not rectifying the nonchalant attitude of 5th Respondent for consciously causing inordinate delay in the investigation of Cr.No. 1458 of 2016, during his periodical review of SC/ST (POA) Act cases or during monthly Crime meetings held by him and further declare the inaction of 5th Respondent for keeping the investigation of Cr.No. 1458/2016 of P.S L.B. Nagar pending contrary to Section 7 of SC/ST(POA) Act 1989 in an unfair manner, as illegal, arbitrary and violative of Article 14 and 21 of the Constitution and pass such other or further orders as this Hon’ble Court deems fit and proper in the circumstances...”

2. Heard Mr. B.Subash, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for the respondents.

3. Learned counsel for the petitioner submits that, challenging the inaction on the part of the respondent police authorities in investigating Crime No. 1458 of 2016, the present writ petition has been filed seeking appropriate directions.

4. Learned Assistant Government Pleader for Home submits that the said crime has been duly investigated, and a final report was filed before the Court of the Special Judge for SC/ST (Prevention of Atrocities) Cases, L.B. Nagar, Ranga Reddy District, on 16.03.2019, categorizing the matter as false. Hence, nothing further remains in this petition for consideration.

5. I have perused the material available on record.

6. Having regard to the grievance of the petitioner and the developments that transpired during the pendency of this petition, it is evident that the respondent police authorities have duly addressed the petitioner’s grievance. However, reserving liberty to the petitioner to avail appropriate remedies available under law against the final report filed by the respondent police authorities, if the cause of action still survives, this writ petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
