THE HON’BLE SRI JUSTICE N.V.SHRAVAN KUMAR Writ Petition No.34060 of 2025 Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing on behalf of respondents.

With their consent, this writ petition is taken up for disposal.

2. This writ petition is filed seeking the following prayer:

“…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.4 issuing the notice to the petitioners under Section 91/160 Cr.P.C, dated 05.11.2025, in relation to the Crime No.416/2016 on the file of 5th respondent and quash the same as being illegal, arbitrary, without jurisdiction, made in abuse of process of law and amounting to malicious prosecution and Consequently direct the official respondents Stay the operation of the impugned notice issued under Section 91/160 Cr.P.C dated 05.11.2025 and pass and to pass…”

3. The petitioners are aggrieved by the notice issued by the respondent No.5 dated 05.11.2025 under Section 91/160 Cr.P.C. calling them to produce documents even though a civil suit vide O.S. No.87 of 2015 is pending on the same subject matter between the petitioners
