JUDGMENT: (Per Hon’ble Justice Moushumi Bhattacharya)

1. Mr.M.Sandeep, Advocate, submits that Mr.K.Ravi Mahender, learned counsel appearing for the appellant/plaintiff has filed No Objection and is not representing the appellant anymore.

2. Learned counsel appearing for the respondent Nos.6, 7,12 to 16, 19 to 22, 24 to 32 (defendants) submits that the appellant is enjoying an order of status quo passed on 21.05.2024 in an I.A. filed by the appellant which is supplemented by an order passed by a Co-ordinate Bench of this Court on 23.05.2024 clarifying the said order to afford protection to the appellant.

The appellant before this Court is the plaintiff, who filed a Suit vide O.S.No.47 of 2024 in the Court of the Principal District Judge, Ranga Reddy District at L.B.Nagar (‘Trial Court’) in the year 2024, for perpetual injunction against the defendants in respect of the suit schedule property. The appellant also filed an interlocutory application i.e., I.A.No.77 of

2024 in O.S.No.47 of 2024 seeking ad-interim injunction against the defendants. By the impugned docket order dated 21.05.2024, the Trial Court directed both the parties to maintain status quo in respect of the suit schedule property till 05.06.2024 and listed the matter on 05.06.2024. The appellant filed the present CMA on 23.05.2024 against the said order of the Trial Court.

A Co-ordinate Bench of this Court granted further protection in favour of the appellant on 23.05.2024 by clarifying that the order of status quo passed by the Trial Court shall not come in the way of the appellant in providing maintenance services as well as finishing the pending work in the villas owned by the appellant.

We do not find any reason to continue the Appeal, since the appellant continues to enjoy the protective orders passed by the Trial Court as well as that of a Co-ordinate Bench of this Court and has also been given sufficient leeway to complete the pending works as well as to provide maintenance services in the villas being constructed over the suit schedule property.

6. We must also mention that we do not find any basis in the Appeal proposed to be filed against the impugned order dated 21.05.2024 by which the status quo was granted in favour of the parties.

7. We are also informed that the appellant’s I.A. i.e., I.A.No.77 of 2024, is now ready for hearing and the only reason why the hearing is not being taken up is because of the pendency of the present CMA.

8. We hence do not find any reason to keep the CMA pending.

9. CMA No.270 of 2024 along with all connected applications, is accordingly disposed of in terms of the above. The order of status quo passed by the Trial Court wherein further protection was granted to the appellant by a Co-ordinate Bench of this Court shall remain in force till a decision is passed by the Trial Court in the pending I.A. The Trial Court shall make its best effort to expedite the hearing of the I.A. and pass its decision as soon as possible. There shall be no order as to costs.
