ORDER :
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:
“...pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus, declaring the action of Respondent No.3 in not considering the representation of the petitioner Dt.13-10- 2025 seeking to restore pathway to agricultural land of the petitioner to an extent of Ac.2-04 gts. by reopening the traditional cart-track (bandla baata) in Survey No. 445- AA2/1, situated at Agraharam Village, Jillella Cheruvu Revenue Village, Kusumanchi Mandal, Khammam District, as illegal, arbitrary, unjust and in violation of principles of natural justice and in violation of articles 14, 21, 300-A of the Constitution of India and consequently direct the respondents No.3 to consider the representation of the petitioner Dt. 13-10-2025 by conducting enquiry and reopening the traditional cart-track (bandla baata) in Survey No. 445-AA2/1, situated at Agraharam Village, Jillella Cheruvu Revenue Village, Kusumanchi Mandal, Khammam District in accordance with law and pass...”
2. Heard learned counsel appearing for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue, for respondent Nos.1 to 5 and perused the record.

Learned counsel appearing for the petitioner would submit that the petitioner herein is the absolute owner and possessor of agricultural land to an extent of Acs.2.04 guntas in Sy.No.445-AA2/1, situated at Agraharam Village, Jillella Cheruvu Revenue Village, Kusumanchi Mandal, Khammam District. The petitioner acquired the subject property from her father at the time of her marriage on 27.06.2007. Subsequently, the name of the petitioner was also mutated in the revenue records and the revenue officials also issued pattedar passbook and title deed vide Passbook No.T26090050735, Khata No.1213. Since then, the petitioner is in peaceful possession and enjoyment of the subject property and she is also receiving Rythu Bandhu from the Government of Telangana.

In order to reach the petitioner’s agricultural land, the only way is to go through a cart-track (bandla batta) which is situated between Sy.Nos.440 and 441 belonging to respondent No.6 and the same route has been used by the family members of the petitioner and other villagers over 50 years to access their agricultural lands. During 2019-2020, the National Highway No.365 BB road was constructed on the southern side of the land Sy.Nos.440, 441 and 445. After the construction of National Highway, respondent No.6 filled up the cart-track and included the cart-track in his land and closed the pathway by fencing the entire land thereby blocking the petitioner’s only access route to her agricultural land.

When the petitioner asked for the pathway which has been in existence since long time, respondent No.6 gave evasive reply and the petitioner visited the offices of respondent Nos.3 and 4 to cause enquiry. The petitioner already lost one crop of agriculture due to non access to her land. After several oral requests to peruse the naksha and cause enquiry to elicit the truth, respondent No.3 did not pay heed, as such the petitioner submitted written representation dated 13.10.2025 to the respondent- authorities, bringing the above facts and requested to restoration of the traditional cart-track. Despite receiving the same, the respondent-authorities have not acted upon it.
Hence, the present writ petition.
6. Learned Assistant Government Pleader for Revenue would submit that the representation submitted by the petitioner dated 13.10.2025 is under consideration. The respondent-authorities shall consider the same and pass appropriate orders.
