O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the official respondents herein particularly 5th respondent who is LW19 in the charge sheet in not properly conducting the investigation of the matter on hand and filing lopsided charge sheet No. 123/2017 in PRC No. 6 of 2017 (New Crime No. 69 of 2016 dated 11/03/2013 on the file of 5th respondent corresponding to old crime No.356 of 2014 on the file of 6th respondent) without properly completing investigation on sound principles of law and procedures thereby rendering the prosecution case impaired as being unjust, against procedures of criminal jurisprudence, arbitrary, unconstitutional and against the principles of natural justice and consequently to direct re-investigation of the case by entrusting the task of investigation to some other independent agency or state law enforcing body and to file additional charge sheet to appropriately plug the loop holes and lacuna which has already crept in the present charge sheet on record vide charge sheet No. 123/2017 dated 20-04-2017 vide PRC No. 6 of 2017 on the file of Hon’ble XII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad and to grant...”

2. Heard Ms.C.Sunitha Kumari, learned counsel representing Mr.A.Suryanarayana, learned counsel appearing for the petitioners and Mr. D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 6.

3. Learned counsel for the petitioners submits that the respondent police authorities did not conduct the investigation properly and charge sheet was filed, as the investigation was lopsided seeking a direction for re-

investigation of the case and for entrustment of investigation to another independent agency, this writ petition was filed.

4. Learned Assistant Government Pleader for Home appearing for respondent Nos. 1 to 6 submits that in Crime No. 123 of 2017 charge sheet was filed and PRC No. 6 of 2017 has been registered. Thereafter, S.C. No. 68 of 2020 was numbered on the file of the IV Additional Metropolitan Sessions Judge, Hyderabad, and the same is pending for trial. Hence, prayed for dismissal of the petition.

5. I have perused the material available on record.

6. Having considered the grievance of the petitioners and the developments reported by the learned Assistant Government Pleader for Home, at this stage directing the respondents for re-investigation by entrusting the task of investigation would not be proper. Leaving open the liberty to the petitioners to avail available remedies before the trial Court to the petitioners, this writ petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
