THE HONOURABLE SRI JUSTICE E.V. VENUGOPAL
Angarika Shoba – Appellant
Versus
The State of Telangana – Respondent
WP 34723/2025
THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.34723 of 2025
ORDER
This Writ Petition is filed praying this Court to declare the action of respondent No.3 authority in not passing orders on the representation, dated 8.10.2025 submitted by the petitioner for conversion of his agricultural land admeasuring Ac.0.05 ½ guntas in Sy.No.139B/D (old Sy.No.139/B), situated at Huzurabad Shivar, Huzurabad Mandal, Karimnagar District into non-agricultural purpose under the provisions of the Telangana Agricultural Land (Conversion for Non-Agricultural) Purposes Act, 2006 (for short “the NALA Act”) as illegal, arbitrary, null, void, violative of principles of natural justice and violative of Articles 14, 19 and 21 of the Constitution of India and consequently, direct respondent No.3 to issue appropriate proceedings and for other appropriate reliefs.
2. Heard Sri K.Venumadhav, learned counsel for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is being disposed of at the admission stage.
3. Learned counsel for the petitioner would submit that the petitioner is the owner and possessor of the agricultural land admeasuring Ac.0.05 ½ guntas in Sy.No.139B/D (old Sy.No.139/B), situated at Huzurabad Shivar, Huzurabad Mandal, Karimnagar District, having acquired the same by way of succession from her husband by name Chinna Rajanna. Learned counsel for the petitioner would further submit that the revenue authorities also incorporated the name of the petitioner in all the revenue records and issued pattadar passbook No.T17060104746 vide Khata No.61305 under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020. Learned counsel for the petitioner would further submit that the petitioner intended to construct a residential house in the subject land and therefore, she made a representation, dated 28.10.2025 before respondent No.3 seeking for conversion of the said land from agricultural to non-agricultural purpose. Learned counsel for the petitioner would further submit that, as no action is taken by respondent No.3 and the intention of the petitioner to construct a house in the said land has been pending, he would seek to issue appropriate directions to the respondent authorities.
4. Learned Assistant Government Pleader for Revenue would submit that, as per the procedure laid down under the NALA Act, necessary online application has to be filed and as the petitioner made only physical representation, the respondent authorities are not in a position to take action on the said representation and that, if the petitioner files online application duly enclosing the necessary documents by paying requisite fee, the respondent authorities will act upon such application.
5. Having heard the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue and since the petitioner had already made the representation for conversion of the subject land from agricultural to non- agricultural purpose, this Court, deems it appropriate to dispose of this writ petition directing respondent No.3 to act upon the representation, dated 28.10.2025 submitted by the petitioner and if the said representation fulfils all the requirements under the provisions of the NALA Act and if it is otherwise in order, collect necessary fees for conversion of the subject land and pass appropriate orders in accordance with law.
6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
