ORAL ORDER
Heard Mr. Akella Sreenivasa Rao, learned counsel for the petitioners.
2. Defendant Nos.1 to 3 in O.S. No.1216 of 2022 pending on the file of IV Additional District and Sessions Judge, Medchal - Malkajgiri District at Kushaiguda, filed the present revision under Article - 227 of the Constitution of India, seeking a direction to the trial Court to dispose of the said suit in accordance with law as expeditiously as possible.
3. Respondent No.1 filed the aforesaid suit for partition and separate possession against the petitioners and respondent Nos.2 to 4 herein. It is stated in the present revision that the petitioners herein have already filed an application under Order - VII, Rule - 11 (a) of CPC for rejection of plaint. There is no cause of action in the plaint. Petitioner Nos.1 and 2 are 75 and 70 years respectively and they are senior citizens. Petitioner No.1 underwent operation on four occasions, and also fifth is Neurosurgery. They are totally dependants on the suit schedule properties. Even then the trial Court is not disposing of the said suit in accordance with law.

Perusal of the plaint filed by respondent No.1 herein would reveal that petitioner No.1 - defendant No.1 was aged about 69 years, while petitioner No.2 - defendant No.2 was 63 years as on the date of filing of the said suit. They are now aged 72 years and 66 years respectively. They are senior Citizens. The suit is for partition and separate possession of suit schedule properties. The year 1999 was observed as “International Year of Older Persons”. In view of the “National Policy for Older Persons” adopted by the Government of India, the erstwhile High Court of Andhra Pradesh at Hyderabad issued a Circular vide ROC.No.4790/1999/OP Cell-E, dated 02.11.1999 directing all the Judicial Officers in the State to identify and dispose of matters in which persons above “65 years” of age are involved, on priority basis. Subsequently, erstwhile the High Court of 05.12.2003, ROC.No.1230/OP Cell-E/2005, dated 20.08.2005 and ROC.No.3465/E-1/2003, dated 14.12.2011 and the High Court of Judicature at Hyderabad for the States of Telangana and Andhra
20.12.2014, in which specific instructions are issued to give priority to the cases relating to senior citizens for the expeditious disposal. In the light of the same, notice to respondent No.1 - plaintiff is waived of by invoking power of this Court under Article - 227 of the Constitution of India.
5. In view of the aforesaid discussion, this Civil Revision Petition is disposed of directing IV Additional District and Sessions Judge, Medchal - Malkajgiri District at Kushaiguda, to dispose of O.S. No.1216 of 2022 in accordance with law as expeditiously as possible.
In the circumstances of the cases, there shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the revision shall stand closed.
