This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…to declare the in action of the Respondent No. 2 not to initiating the actions against the complaint lodged by the petitioner dated 22.01.2018, to the Respondent no. 2 has refused receive the same was send by through a registered post and the acknowledgement issued by the Postal Department herein filed is illegal, arbitrary and contrary to the provisions of law by issuing a Writ of Mandamus or any other appropriate writ, order or directions to initiate the proceedings in complaint lodged by the petitioner herein dated 22.01.2018 and pass.......”
2. Heard Mr.Dantu Venkata Ramana Sarma, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 and 2.
3. Learned counsel for the petitioner submits that the cause of action in the present writ petition no longer survives for adjudication and, therefore, seeks dismissal of the writ petition as infructuous.
4. Learned Assistant Government Pleader raises no objection to the said submission.
