ORDER

This writ petition is filed seeking the following prayer:

“…to issue one in direction Writ of Mandamus, declaring the in action of the Respondent No.2 to 5 not conducting the Survey in the Petitioners land in Sy No. 255/3, 258A/1, 258A/3, 258A/4, 259/2, 259/3, 260/1, 272B/a/1, 284/4, 286A/3, 286A/4, 287A1/1, 287A1/3,, 287A1/4, 287C/1, 287C/3, 287C/4 to an extent of Ac. 0.0600gts, 0.2500gts, 0.2500gts, 0.1300gts, 0.3600gts, 0.0700gts, 1.1850gts, 0.1200gts, 0.0500gts, 1.1400gts, 0.2700gts, 0.2200gts, 0.1150gts, 0.2200gts, 0.2200gts, 0.1150gts. respectively, situated at Obulapur Village, Thangellapalli Mandal of Rajanna Sircilla District is illegal, irregular and improper and violation of principles of natural justice and also violative of Articles 14, 21 and 300-A of Constitution of India and consequently dispose the Petitioners Online applications F-Line Petitions vide No.DER022501146304 and DER022501146300 dated 04-03-

Heard Ms.A.Shivani, learned counsel representing Mr.Boosa Shivachandra, learned counsel for the petitioner and Sri L. Ravinder, learned Assistant Government Pleader for Revenue. Perused the record.

Learned counsel for the petitioner would submit that the petitioner is the original resident of Rajanna Sircilla District having lands in Sy.Nos.255/3, 258A/1, 258A/3, 258A/4, 259/2, 259/3, 260/1, 272B/a/1, 284/4, 286A/3, 286A/4, 287A1/1, 287A1/3, 287A1/4, 287C/1, 287C/3, 287C/4 to an extent of Ac.0.0600 gts, 0.2500 gts, 0.2500 gts, 0.1300 gts, 0.3600 gts, 0.0700 gts, 1.1850 gts, 0.1200 gts, 0.0500 gts, 1.1400 gts, 0.2700 gts, 0.2200 gts, 0.1150 gts, 0.2200 gts, 0.2200 gts, 0.1150 gts, respectively, situated at Obulapur Village, Thangellapalli Mandal of Rajanna Sircilla District (herein after referred as “suit properties”). The above said lands are conveyed to the petitioner through a valid sale consideration. Since the date of conveyance, the petitioner is in possession of the suit properties. The petitioner filed F-Line applications on 04.03.2025 to conduct survey of lands pertaining to the petitioner. Respondent Nos.4 and 5 acknowledged the same, but no action has been taken by them. Learned counsel for the petitioner relied upon the judgment passed by this Court in W.P.No.32785 of 2022 and seeks to allow this writ petition.

3. Mr.L.Ravinder, learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.5 will consider the representation in accordance with law.

In the light of the said submission, this Writ Petition is disposed of directing respondent No.5 to consider the representations dated 04.03.2025 submitted by the petitioner to conduct survey and Sub-division survey in accordance with law, by putting the petitioner and all interested parties on notice and affording them an opportunity. If respondent No.5 is not inclined to accept the request made by the petitioner, he shall assign specific reasons, pass a reasoned order and communicate copy of the same to the petitioner. However, he shall complete the entire exercise within a period of eight (08) weeks from the date of receipt of a copy of this order.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
