THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13972 OF 2025

ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner/A.1 seeking anticipatory bail in connection with Crime No.650 of 2025 of S.R Nagar Police Station, Hyderabad. The offences registered against the petitioner are under sections 143, 144(2) of Bharatiya Nyaya Sanhita (for short ‘BNS’) and under Sections 3, 4 and 5 of PIT Act.

The case of the prosecution is that on credible information about organizing of prostitution at Flat No.105, Everest Bloc-C, Aditya Enclave, Ammerpet, Hyderabad, at about 18:45 hours, the S.I of Police, S.R. Nagar Police Station along with his staff and panchas, conducted a raid at the said premises and upon knocking the door, a male person named Gunnam Prabhu opened the door, and he instructed PC 30670 J Venkata Sai Teja to record the proceedings and served the search notice. During the search, they found two female sex workers, one engaged with a customer named Ananthula Ugender. Prabhu confessed to have organizing the brothel under the guise of "Laxmi Bricks Suppliers" with absconding associates Srinivasulu and Satyanarayana, who procured sex workers from Andhra Pradesh and Telangana, paid them daily commissions, and directed customers to the premises. Prabhu acted as a sub- organizer since June 2025, earning Rs.25,000/- monthly and collecting Rs.2,500/- per client.

3. Heard Sri Y.Soma Srinath Reddy, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

4. The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations. There is no direct evidence against the petitioner to support the alleged allegations. There is no evidence to show that the alleged victim is being trafficked as such, the provisions under Section 143 of BNS does not attract to the petitioner. Further, the offences under Sections 3, 4 and 5 of PIT Act are punishable with below seven years and the police ought to have followed procedure under section 35(3) of BNSS and in order to implicate the petitioner Sections 143 and 144 of BNS were added. The petitioner herein is implicated in this case basing on the confession of co-accused which is not admissible in evidence and there is no independent material to connect the petitioner with the alleged crime. Hence, prayed this Court to grant anticipatory bail to the petitioner.

On the other hand, learned Additional Public Prosecutor vehemently opposed bail on the ground that the allegations against the petitioner are serious in nature, that he is running brothel house by trafficking the women from other places. If bail is granted the petitioner may commit the similar offence. As such petitioner is not entitled for bail and prayed to dismiss this criminal petition.

6. Considering the submissions made by both the counsel and the material on record, it is seen that the petitioner is the main organizer of the brothel house. This is the second bail application. Earlier petitioner filed Crl.P.No.12480 of 2025 which was dismissed by this Court in view of the severity of allegations. There are no changed circumstances back then in the earlier bail petition and the present petition. Considering the severity of allegations, this Court is not inclined to grant bail to the petitioner and the same is liable to be dismissed.

7. Accordingly, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending shall stand closed.
