THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13945 OF 2025

ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner/A.1 seeking anticipatory bail in connection with FIR No.510 of 2025 of Mavala Police Station, Adilabad District. The offences alleged against the petitioner are under Sections 316 (5), 318(4) r/w.3(5) of Bharatiya Nyaya Sanhita, 2023.

The facts of the case are that a complaint was lodged by the complainant on 26.09.2025 at 21:00 hrs, stating that Chittapuwar Rahul and his cousin Dasari Srikanth, both from Kailash Nagar, had received job appointment letters as computer operators from Laxminarayana, petitioner herein a retired teacher from Kolam Ashrama School. Believing it to be true, the complainant contacted the petitioner who claimed to be an agent for Anantha Solution Career Opportunity in Adilabad and said he had helped many people in getting jobs. The petitioner promised the complainant a computer operator job at Umri Ashrama School for Rs.1,10,000/-. On 08.02.2025 at 18:40 hrs, the complainant paid the amount through PhonePe from his brother Swaphnil’s account to petitioner’s account. The next day, petitioner sent an application form via WhatsApp and asked the complainant to fill and return it, which he did. Two days later, petitioner called and informed him that the job was confirmed and that he would receive the appointment letter within a week. The complainant waited for a month but did not receive the letter and when he called petitioner, he stated that complainant would get it in 10 days, but after that petitioner stopped responding. Hence, the complainant alleged that he was cheated and requested the police for necessary action against the petitioner and the owner of Anantha Solution Career Opportunity. Basing on the said complaint the police registered the case against the accused for the said offences.

3. Heard Sri Soma Ravi Kiran Reddy, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The learned counsel for the petitioner contended that the petitioner is innocent of the alleged allegations, that the police without conducting preliminary enquiry, straight away registered the case against the petitioner. He further contended that without there being any evidence, petitioner was implicated in this case and even the offences alleged against the petitioner does not attract to him. As such, prayed this Court to grant anticipatory bail to the petitioner.

5. On the other hand, learned Additional Public Prosecutor opposed bail on the ground that under the guise of providing job to the complainant, he took money and cheated him. The petitioner herein is also having previous crime history and the investigation is still in progress. Hence, petitioner is not entitled for bail and prayed to dismiss this petition.

6. Considering the submissions made by both the counsel and the material on record, it is seen that on the guise of providing job, petitioner has collected money from the complainant and cheated him. Further petitioner is also involved in two other crimes for the same allegations. Hence, this Court is not inclined to grant bail to the petitioner and the same is liable to be dismissed.

7. Accordingly, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending shall stand closed.
