ORDER:
This criminal petition is filed by the petitioner-accused No.1 seeking to quash the proceedings in C.C. No.571 of 2021 on the file of XXIV Additional Metropolitan Magistrate, Hayathnagar, Rachakonda, for the offences under Sections 420 and 406 IPC.
2. Heard Mr. P. Vamsheedhar Reddy, learned counsel for the petitioner and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for the respondent No.1-State.
3. Learned counsel for the petitioner has submitted that the petitioner is innocent of the offences alleged against him and that even if the entire complaint is taken into consideration, no offences under Sections 420 and 406 IPC are made out against the petitioner. He further submitted that during the pendency of the investigation, the respondent No.2-de facto complainant has given representation to the Investigating Officer for withdrawing case against the petitioner as it was learnt by respondent No.2 that the petitioner has wound up his chit business 4 years back and that without the knowledge of the petitioner, accused No.2 played fraud and collected the amount as if the petitioner-accused No.1 is in continuation of h
