ORDER

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4. With their consent this writ petition is taken up for disposal at the admission stage itself. Notice to respondent Nos.5 to 7 is hereby dispensed with.

2. This writ petition is filed seeking following prayer:-

“…declaring the action of the respondent No.3 herein providing police protection to the petitioner and family members to pursuant to the injunction orders dated 24.06.2025 in I.A.No.2 of 2025 in O.S.No.489 of 2025 on the file of the IV Addl Junior Civil judge cum Special Mobile Court Khammam in respect of the agriculture land admeasuring Ac.0-34gts., in Sy.No.349/A1 Ac.0-36 gts., in Sy.No.350/A2 and 356/AA2 total Ac.2-25 gts., situated at Suridhepally village, Nelakondapally Mandal, Khammam district (subject land) inspite of the written complaint dt.12.08.2025 followed by personal visits as being illegal, arbitrary, unjust and unconditional and consequently direct the respondent No.3 herein to act upon the complaint dt.12.08.2025 and take action against the unofficial respondents as per law”

3. The facts of the case in brief as stated are that petitioner claims to be owner and possessor of subject land having acquired the same by way of gift deed bearing Doc.No.5493/2018 dated

17.09.2018 and pattadar passbooks were issued in his favour. It is submitted that when respondent Nos.5 to 7 are interfering into the peaceful possession of the petitioner, petitioner was constrained to file a suit in O.S.No.489/2025 for perpetual injunction along with I.A.No.2/2025 for grant of interim injunction before the IV Addl.Junior Civil Judge cum Special Mobile Court, Khammam. The trial Court granted an order of interim injunction on 24.06.2025 restraining respondent Nos.5 to 7 not to interfere into the petitioner’s possession. Despite having interim injunction in petitioner’s favour, on 17.08.2025 respondent Nos.5 to 7 along with their henchmen planned to kill the petitioner with electrical wire and also destroyed the paddy crop and caused damage to a tune of Rs.50,000/-. In that regard, petitioner lodged a complaint before respondent No.3 which is registered as Cr.No.187/2025 under Sections 329(3), 296, 351(2) read with Section 3(5) BNS against respondent Nos.4 to 7. It is submitted that after registering FIR, no action has been taken on unofficial respondent Nos.4 to 7. Questioning the same, the present writ petition is filed.

Today, when the matter is taken up for hearing, learned Assistant Government Pleader, on instructions, would submit that respondent No.5 lodged a complaint against the petitioner stating that petitioner and others damaged their crop worth Rs.30,000/-. Basing on the said complaint, respondent Police registered FIR No.189/2025 dated 20.08.2025. Basing on the complaint of petitioner, respondent Police registered FIR No.187/2025 against respondent Nos.5 to 7. It is submitted that both the FIRs are still pending for further adjudication.

In that view of the matter, this writ petition is disposed of directing respondent No.4 to the extent of providing police protection to the personal life and liberty of the petitioner is concerned on need and necessity basis. Respondent authorities are directed to follow due procedure as contemplated under law for further course of action. It is also made clear that the petitioner shall cooperate with the pending FIR No.189 of 2025.

6. With the above directions, this writ petition is disposed of. Miscellaneous applications, if any pending, shall stand closed.

No order as to costs.
