O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a writ order or direction more particularly one in the nature of writ of Mandamus or any other appropriate writ by declaring the in action of the Respondent No.4 in not arresting the 5th Respondent herein and Accused No.8 in Crime No.17 of 2016, registered on 31-01-2016 and not filing supplementary charge sheet in C.C. No.304 of 2016 on the file of Judicial Magistrate First Class at Suryapet, Nalgonda District as illegal, arbitrary and violation of principles of Natural Justice and consequently direct the Respondents 1 to 4 to file supplementary charge sheet in C.C.No.304 of 2016 on the file of Judicial Magistrate First Class at Suryapet, Nalgonda District by arresting the 5th Respondent and pass......”

2. Heard Mr.Krishnamurthy Devarakonda, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4.

3. Learned counsel for the petitioner submits that the cause of action in the present writ petition no longer survives for adjudication and, therefore, seeks dismissal of the writ petition as infructuous.

4. Learned Assistant Government Pleader raises no objection to the said submission.

5. Recording the submissions of both learned counsel, the writ petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
