THE HONOURABLE SMT. JUSTICE K. SUJANA TRANSFER CRIMINAL PETITION No.117 of 2025

ORAL ORDER:

This Transfer Criminal Petition is filed by the petitioners to transfer DVC.No.30 of 2022 on the file of the learned Principal Judicial Magistrate of First Class, Suryapet to any competent Court at Hyderabad.

2. Heard Sri M. Pratap Singh, learned counsel appearing on behalf of the petitioners as well as Sri Y Ashok Kumar, learned counsel appearing on behalf of respondent Nos.2 and 3 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent – State.

3. Learned counsel for the petitioners submitted that both parties are residing in Hyderabad, and the earlier maintenance case was also transferred to Hyderabad from Suryapet. Therefore, he prayed the Court to transfer DVC No.30 of 2022 from Suryapet to Hyderabad.

4. On the other hand, learned counsel for respondent Nos.1 and 2 did not raise any objection to the transfer of the case and prayed the Court to pass appropriate orders.

5. In the light of the submissions made by both the learned counsel and a perusal of the material available on record, as both the parties are residing at Hyderabad, this Court deems it fit to transfer DVC.No.30 of 2022 from the file of the Principal Judicial Magistrate of First Class, Suryapet to the file of the III Metropolitan Magistrate at Kalpataru, Hyderabad.

6. Accordingly, the Transfer Criminal Petition is allowed. DVC.No.30 of 2022 stands transferred from the file of the Principal Judicial Magistrate of First Class, Suryapet to the file of the III Metropolitan Magistrate at Kalpataru, Hyderabad. The Court concerned is hereby directed to transmit the entire case file relating to DVC.No.30 of 2022, after duly indexed, within a period of One (1) month from the date of receipt of a copy of this Order, under intimation to the other side.

Miscellaneous applications, if any pending, shall stand closed.
