THE HONOURABLE SRI JUSTICE E.V. VENUGOPAL
Smt. Vadla Sugunamma – Appellant
Versus
The State of Telangana – Respondent
WP 33487/2025
THE HON’BLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.33487 OF 2025
O R D E R:
This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief/s:-
“... to issue a Writ, Order or Direction, more particularly one in the nature of Mandamus, declaring the action of the 3rd and 4th respondent in entertaining mutation proceedings and registration in respect of land of the petitioner situated in Survey Nos.284, 285, and 288 of Bachupally Village and Mandal, Medchal-Malkajgiri District at the instance of 6th respondent without considering the representation of the petitioners dated 01-11-2025, as illegal, arbitrary, and violative of Articles 14, 21 and 300-A of the Constitution of India and the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020 and Registration Act, 1908 and consequently direct the respondents No.1 to 5 not to entertain any mutation or registrations in the above said property in favour of respondent No. 6 or his nominees and pass such other order or direction …”
2. Heard Mr.N.Ravi Prasad, learned counsel for the petitioners and Mr.L.Ravinder, learned Assistant Government Pleader representing learned Government Pleader for Revenue appearing for respondent Nos.1 to 5.
3. Learned counsel for the petitioners submits that respondent No.6 is illegally attempting to manipulate the revenue records and trying to mutate his name in the joint family properties situated in survey Nos.284, 285 and 288 of Bachupally Village & Mandal, Medchal-Malkajgiri District. He states that the petitioners have also submitted representation dated 01.11.2025 before respondent No.4 requesting to withhold registration of documents with respect to their joint family properties in the said survey numbers, to conduct a detailed enquiry and pass appropriate orders. But no such orders are passed by respondent No.4 till date. Therefore, he seeks indulgence of this Court.
4. Learned Assistant Government Pleader for Revenue contends that the petitioners filed this Writ Petition on a mere apprehension that unofficial respondent No.6 would mutate his name in the revenue records with respect to their joint family properties and the petitioners failed to file any documentary proof to that effect. Therefore, he seeks to dismiss this Writ Petition.
5. Having regard to the submissions of both the learned counsel and on perusal of the material available on record, this Court without making any observations on the merits or demerits of the case, is inclined to dismiss the Writ Petition by granting liberty to the petitioner to work out the remedies as available under law. No costs.
Miscellaneous petitions pending, if any, shall stand closed.
