THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.33358 of 2025

ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a Writ of Mandamus declaring the action of the Respondent Nos.2 to 4 in not taken action on the representations made by Petitioner’s son by name K.Kiran Kumar Reddy on Petitioners behalf on 12.06.2020 and not receiving the complaint dated 10.09.2025 requesting to take necessary action to rerecord Petitioner’s name in respect of land to an extent of Ac.6.32 Guntas in Sy. No.173 of Gondiyala Village, Hanwada Mandal, Mahbubnagar District, by deleting the name of 5^th Respondent is illegal, arbitrary and consequently to direct the Respondent Nos.2 to 4 to conduct the enquiry representations made by Petitioner’s son by name K.Kiran Kumar Reddy on petitioners behalf on 12.06.2020 and to take necessary action to rerecord Petitioners name in respect of land to an extent of Ac.6.32 Guntas in Sy. No.173 of Gondiyala Village, Hanwada Mandal, Mahbubnagar District, by deleting the name of 5th Respondent …”

2. With the consent of both the parties, this Writ Petition is taken up for disposal, at the admission stage.

3. Heard learned counsel for the petitioner and Revenue appearing for respondent Nos.1 to 4. Perused the record.

Learned counsel for the petitioner submits that the husband of the petitioner was the owner of agricultural land to an extent of Ac.6.32 guntas in Sy.No.173 of Gondiyala Village, Hanwada Mandal, Mahabubngar District (herein after referred as “subject land”) and his name was recorded in the revenue records from 1979-80. The husband of the petitioner died in the year 1994. Taking advantage of illiteracy of the petitioner and her son rendered services in Army, respondent No.5 illegally entered in his name in the Revenue records in respect of the subject land.

It is further submitted that having come to know the same, the son of the petitioner made a representation dated 12.06.2020 before respondent No.2 to delete the name of respondent No.5 and to enter his name in the Revenue records. After receiving the same by respondent No.2 and after acknowledging on the same, no action has been taken by respondent Nos.2 to 4 for rectification of the name of son of the petitioner. Therefore, seeks to pass appropriate orders.

Revenue, on instructions, would submit that respondent Nos.2 to 4 will consider the representations in accordance with law and pass appropriate orders.

Having heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue, this Writ Petition is disposed of directing petitioner to file fresh online application along with necessary documents and upon filing the same, respondent Nos.2 to 4 are directed to consider the same and enquire into the matter and pass appropriate orders, strictly in accordance with law, by issuing necessary notices to the petitioner and all other interested parties and afford them sufficient opportunity of hearing, as expeditiously as possible preferably, within a period of eight (08) weeks from the date of receipt of such application.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
