ORDER:
Heard Sri T. Kistaiah, learned counsel appearing on behalf of the petitioner, learned Government Pleader appearing on behalf of respondent Nos.1 and 2, Sri T.Vasantha Rao, learned counsel appearing on behalf of respondent No.3 and Sri Mirza Younus Ali Baig, learned counsel appearing on behalf of respondent No.4.
2. PRAYER :
The Petitioner approached this Court seeking the prayer as under :
“To issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the impugned resolution dated 16.09.2022 in appointing the 4th respondent as CEO in place of petitioner and subsequent notice dated 26.01.2023 terminating the petitioner service is illegal, arbitrary unconstitutional and consequently set aside the same, and pass such other order…”
3. Case of the Petitioner as per the averments made by the petitioner in the affidavit filed by the petitioner in support of the present writ petition in brief is as under :
(i) The petitioner was initially appointed on 01.08.1999 and promoted as Staff Assistant/Cashier on 14.07.2011 in the 3rd respondent-society. The petitioner was subsequently promoted as CEO on 07.04.2017 and rendered about 22 years of satisfactory service. In pursuance of G.O.Ms.No.151, Agriculture & Cooperation (Coop.VII), dated 22.06.2009, the petitioner’s pay was fixed in the revised pay scales with effect from 01.04.2009. As of August 2022, the petitioner was drawing a time-scale pay of Rs. 5,110/- and a gross salary of Rs. 54,406/-.
(ii) It is further case of the petitioner that 3rd respondent-society illegally passed a resolution on 16.09.2022 appointing one Bharath Kumar, the 4th respondent herein, as CEO in the petitioner’s place, even though the management has no authority to do so without prior permission of the Registrar. Following this illegal resolution, the petitioner’s salary was unilaterally reduced to Rs. 25,000/- from September 2022, causing harassment and financial loss.
(iii) The petitioner therefore seeks to have the impugned resolution dated 16.09.2022, appointing the 4th respondent as CEO, and the subsequent termination notice dated 26.01.2023, declared illegal, arbitrary, and unconstitutional, and to have them set aside. The petitioner also seeks continuation as CEO with full salary pending disposal of the writ petition. Hence, the present writ petition has been filed.

(A) The impugned Resolution dated 16.09.2022 passed by the 3rd respondent is extracted hereunder :
