THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.14007 of 2025

ORDER:

This Criminal Petition is filed under Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioners/accused Nos.1 to 7seeking to quash the proceedings against them in Crime No.351 of 2025 on the file of Toopran Police Station, Medak District.

2. Heard Mr.Gundaram Manoj Goud, learned counsel for petitioners and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.

3. Learned counsel for the petitioners submits that the petitioners are facing false allegations and that the petitioners Nos. 4 and 5 are aged persons facing false allegations. He further submits that the allegation of trespass has been levelled against the petitioners merely to settle scores in the civil matter pending between the parties. He also submits that all the offences are punishable with less than seven years of imprisonment. He, therefore, prayed to direct the Police to invoke the proceedings under Section 35 (3) of BNSS.
