ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:

“…to issue a Writ, order or direction, more particularly a Writ of Mandamus declaring the high handed action of the Respondents 3 and 4 in interfering civil dispute in respect of the lad in Sy.Nos. 61, 62 and 63 to an extent of Ac.2-00 guntas situated at Mallapur Village, Balapur Mandal, Ranga Reddy as illegal, improper, arbitrary, unjust and violative of Article 21 and 300 A of Constitution of India and pass…”

2. Heard Mr. K.Ramamohan, learned counsel for the petitioner and Mr. D.Pradeep, learned Assistant Government Pleader for Home appearing for the respondents.

3. Learned counsel for the petitioner submits that respondent Nos.3 and 4 are interfering with the civil disputes of the petitioner in respect to the petition mentioned land, this petition is filed seeking appropriate directions.

4. Learned Assistant Government Pleader submits that respondent Nos.3 and 4 never interfered with the civil litigation as contented by the petitioner and the allegations are without any basis much less any substantiated. Hence, prayed for dismissal of the petition.

5. I have perused the materials on record.

6. Having regard to the assertion of the petitioner that the respondent police authorities/respondent Nos.3 and 4 are interfering with the civil dispute and the litigations to police authorities in civil matters even during pendency of any criminal proceedings, respondent Nos.3 and 4 are directed to restrain themselves from interfering with the civil disputes and the petitioner in respect of the petition scheduled property. However, any action by the police authorities in strict accordance with law and by following due process is saved.

7. With the above said direction, this writ petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
