HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.32453 OF 2025 ORDER: (ORAL)

This writ petition is filed aggrieved by the action of respondent Nos.2 to 4 in not acting upon the complaint of the petitioner dated 06.10.2025, whereby the petitioner requested respondent No.4 to remove the gates erected by respondent Nos.5 and 6 in her property bearing Plot Nos.16, 17, 28 and 29, total admeasuring 1000 square yards, in Survey No.124/ఏ of Gopanpally Village, Serilingampally Mandal, Rangareddy District.

2. The petitioner claims to be the absolute owner of the aforesaid properties having purchased the same in the year 2020 and had been in possession of the property since then. While so, respondent Nos.5 and 6, who are the local Corporator/resident, had been making attempts to grab the property of the petitioner. In that connection, complaint has been lodged by the petitioner and the same has been registered as FIR.No.2170 of 2025 of Gachibowli Police Station for the offences under Sections 126 (1), 351 (2) of Bharatiya Nyaya Sanhita, 2023, and Section 3 (1) (r) (s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.

3. It is submitted that respondent Nos.5 and 6 have erected a gate in the property of the petitioner, thereby depriving ingress and egress to her. The petitioner lodged a complaint with respondent Nos.2 to 4 on 06.10.2025 to remove the gates erected in her property, but so far action has not been taken. In such circumstances, the petitioner is constrained to approach this Court.

4. Heard Mr. Mayur Mundra, learned counsel, representing Mr. Safdar Mirza, learned counsel for the petitioner, and Mr. G. Madhusudhan Reddy, learned Standing Counsel for GHMC, appearing for respondent Nos.2 to 4, and perused the material available on record.

5. Learned Standing Counsel for respondent Nos.2 to 4 submitted that appropriate action will be taken on the complaint of the petitioner.

Recording the above submission of the learned Standing Counsel, the writ petition is disposed of directing respondent No.3 - Deputy Commissioner, Greater Hyderabad Municipal Corporation, Circle No.20, Serilingampally, Rangareddy District, to act upon the petitioner’s complaint dated 06.10.2025, whereby she requested the respondent authorities to remove the gates erected in her property, by issuing prior notice to the petitioner and respondent Nos.5 and 6 and affording them an opportunity of hearing, and pass orders in accordance with law. This exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. Notice to respondent Nos.5 and 6 is dispensed with as this order is passed without entering into the merits of the case. However, if respondent Nos.5 and 6 are in any way aggrieved by this order, they are at liberty to seek modification of this order. No order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition stand closed.
