O R D E R:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…to issue a writ, order or direction, more in the nature of writ of mandamus under Article 226 of the Constitution of India, declaring the action of the 1st respondent, in not registering FIR u/s 154 of Cr.P.C. against the party respondent and taking further according to law in pursuance of the representation Dated 13.01.2018 filed by petitioner, contrary to the law laid down in case of Lalitha Kumari V State of Uttar Pradesh in WP No. 68/2008 Dated 12.11.2013, as arbitrary, illegal, malafide, discriminatory violating Article 14 and 21 of the Constitution of India and issue consequential directions, directing the 1st respondent to register FIR u/s 154 of Cr.P.C. against the party respondent in pursuance of the representation Dated 13.01.2018 filed by petitioner and take further action according to law, as per the law laid down in case of Lalitha Kumari V State of Uttar Pradesh in WP No. 68/2008 Dated 12.11.2013, in protecting the life and property of the petitioner, and pass.....”
2. Heard Mr.D.A.Prem Chand, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4.
3. Learned counsel for the petitioner submits that the cause of action in the present writ petition no longer survives for adjudication and, therefore, seeks dismissal of the writ petition as infructuous.
4. Learned Assistant Government Pleader raises no objection to the said submission.
5. Recording the submissions of both learned counsel, the writ petition is dismissed as infructuous. There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
