ORDER:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:
“…to issue Writ, order or direction more in the nature of Mandamus, declaring the action of the Respondent.No.4 being a Police officer, without having any Power in his official Capacity, interfering in the civil dispute by forcing the Petitioner to withdraw the Pending Civil Suit which is O.S.No.20 OF 2017 before the Hon’ble IX Additional District Judge at Wanaparthy and being a Police officer, Respondent.No.4, threatening the Petitioner by proceeding to Register false Cases against the Petitioner by colluding the Respondent.No.4 with the Respondent.No.5 as illegal, arbitrary, discriminatory, violation of Articles 14 and 21 of the Constitution of India and consequently direct the Respondent.No.4 not to interfere in the Civil dispute and not to force the Petitioner to withdraw the Pending Civil Suit which is O.S.No.20 OF 2017 before the Hon’ble IX Additional District Judge at Wanaparthy and direct the Respondent.No.4 not to Register any false Cases against the Petitioner and Direct the Respondent.1 to 3 to initiate stringent legal action against the Respondent.No.4 and 5 without insisting in the interest of justice..…”
2. None appears for the petitioner.
3. Heard Mr. D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4.
4. Learned Assistant Government Pleader, on instructions, submits that respondent No. 4 has never interfered with the civil disputes of the petitioner as alleged. It is further submitted that the petitioner’s contention that respondent No. 4 deputed a police constable to threaten him to withdraw the civil suit is baseless and unsupported by any material, apart from the petitioner’s own averments. Hence, the prayer of the petitioner is unfounded and liable to be dismissed.
5. I have perused the material available on record.
6. The petitioner’s grievance is that, despite the disputes being purely civil in nature between himself and the unofficial respondent, respondent No. 4 allegedly interfered in the matter. Such an assertion, even if accepted at face value, only discloses a civil dispute, wherein the police have no role to play.
7. Having regard to the petitioner’s pleadings and the settled principle that police authorities have no jurisdiction to interfere in matters of a purely civil nature, respondent-police authorities, particularly respondent No. 4, are directed to refrain from interfering with the civil disputes between the petitioner and respondent No. 5, and shall not, in any manner, compel or insist upon settlement of such disputes.
8. However, it is clarified that any action by the police taken strictly in accordance with law and by following due process shall stand unaffected by this order.
9. With the above direction, this writ petition is disposed of.
There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
