WRIT PETITION No.32148 OF 2025

ORDER:

This writ petition is filed with the following prayer:

“…to issue a Writ of Mandamus or any other appropriate writ, order, or declaring the inaction of the Respondents as illegal, arbitrary, and violative of the principles of natural justice, and for not considering the RTI application dated 16-09-2025, as the respondents’ failure to comply with the RTI Act, 2005. Direct the respondents to furnish reasons for their arbitrary delay or denial in providing the requested information in compliance with the RTI Act, 2005 and to pass…”

2. Heard Mr. Md. Fasiuddin, learned counsel for petitioner and Ms. Dara Haritha Kiran, learned Assistant Government Pleader for Revenue and Stamps & Registration for respondents.

3. It is the specific case of petitioner that he has sought for certain information and respondent authorities have failed to provide the requested information within prescribed time limit as enumerated under the Right to Information Act, 2005 (Section 7) (for short ‘RTI Act’). Non-granting of information within the prescribed time limit would negate the very purpose of RTI Act. Petitioner has a remedy of appeal too, he can avail such remedies of appeal.

4. It is imperative on the part of authorities discharging duties under RTI Act to dispose of the application within a period of fifteen (15) days. The Act also provides that if any information is not available with the said authority, the application can be forwarded to the concerned authorities for information sought.

5. On considering the submissions made and upon perusal of the record, this Court is of the opinion that authorities be directed to pass orders on the application of petitioner.

6. Respondent authorities are directed to pass orders intimating the petitioner on information sought within a period of Ten (10) days from the date of receipt of a copy of this order.

7. With the above observations, Writ Petition is disposed of. No costs.

Miscellaneous applications pending, if any, shall stand closed.
