THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.32180 of 2025

ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“...to issue an order/direction or writ in the nature of Mandamus directing respondent Nos.2 to 4 to incorporate his name in the revenue record for Ac.1.00 guntas, out of total extent Acs.2.00 guntas, in Sy.No.439/18 situated at Dandepally Village, Yelkaturthi Mandal, Hanamkonda District, in pursuance of his representations or pass such other order or orders...”

2. Heard learned counsel for the petitioner and Mr.L.Ravinder, learned Assistant Government Pleader for Revenue.

Petitioner herein is claiming that his father, namely, late Sri Sudhireddy Hanumaiah was the absolute owner and possessor of land admeasuring Acs.2.00 guntas in Sy.No.439/18, situated at Dandepally village, Yelkaturthi Mandal, Hanamkonda District, on the strength of registered sale deed bearing Document No.1094 of 1973, dated 10.01.1973. His father died 30 years ago. During his lifetime, he partitioned the subject property equally i.e., Ac.1.00 guntas each, to both petitioner and respondent No.5, brother of the petitioner. Since then petitioner along with respondent No.5 used to cultivate the subject property jointly. Recently, he came to know that the name of respondent No.5 was mutated in the revenue record in respect of the subject property and issued pattadar passbook. Thus, there is a wrong entry. Therefore, he has submitted representations dated 25.08.2025 and 15.09.2025 to respondent No.3 – Revenue Divisional Officer with a request to rectify the wrong entry, mutate his name in respect of his share i.e., Ac.1.00 guntas in the revenue record and issue pattadar passbook. Despite receiving and acknowledging the said representations, respondent No.3 did not act upon the same. Aggrieved by the said inaction of respondent No.3, petitioner filed the present writ petition.

Mr.L.Ravinder, learned Assistant Government Pleader for Revenue, on instructions, would submit that respondent No.3 will consider the said representations submitted by the petitioner seeking mutation and issue of pattadar passbook and pass appropriate orders, in accordance with the procedure laid down under law, by putting the petitioner, respondent No.5 and all interested parties on notice and affording them an opportunity.

5. In the light of the said submission, notice to respondent No.5 is dispensed with. This Writ Petition is disposed of directing respondent No.3 to consider and dispose of the representations dated 25.08.2025 and 15.09.2025 submitted by the petitioner seeking mutation of his name in respect of his share i.e., Ac.1.00 guntas in Sy.No.439/18, situated at Dandepally village, Yelkaturthi Mandal, Hanamkonda District, and for issuance of the pattadar passbook, strictly in accordance with the procedure laid down under law, by putting the petitioner, respondent No.5 and all interested parties on notice and affording them an opportunity. If respondent No.3 is not inclined to accept the request made by the petitioner, he shall assign specific reasons, pass a reasoned order and communicate copy of the same to the petitioner. However, he shall complete the entire exercise as expeditiously as possible.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
