Mr.Y.Neelakanta Reddy, learned counsel representing Mr.V.Ravi Kiran Rao, learned counsel for the appellant, on instructions, would submit that the appellant/wife has sent a Whats App message to Mr.V.Ravi Kiran Rao, learned counsel for the appellant, stating that she is not interested to prosecute the present appeal. She has instructed the counsel to withdraw the present appeal. Therefore, he seeks permission of this Court to withdraw the present appeal.
2. Respondent/husband has filed a petition under Section 13(1) (ia)(ib) of the Hindu Marriage Act, 1955 vide F.C.O.P.No.10 of 2022 on the file of learned the Judge, Family Court –cum- Additional District and Sessions Judge, Adilabad, against the appellant seeking dissolution of marriage on the ground of cruelty and desertion.
3. Vide the impugned order dated 09.08.2014, learned Family Court allowed the said petition and dissolved the marriage between the appellant and respondent. Challenging the said order, appellant/wife filed the present appeal.
4. Vide order dated 26.12.2014, this Court suspended the impugned order. Now, she is not interested to prosecute the present appeal. In the light of the said submission, Mr.Y.Neelakanta Reddy, learned counsel had made an endorsement on the bundle to the said effect.
5. Accordingly, this appeal is dismissed as withdrawn.
There shall be no order as to costs.
Miscellaneous applications pending, if any, shall stand closed.
