THE HON’BLE SRI JUSTI CE NAMAVARAPU RAJESHWAR RAO WRI T PETI TI ON No.18789 OF 2007

ORDER:

This Writ Petition is filed seeking the following relief:

“…to issue a Writ or order or direction, especially one in the nature of Writ of Mandamus-

(i) declare the action of the respondents in not issuing order of appointment pursuant to the interview conducted on 25-12-2006 to the selected candidate as illegal and arbitrary.

(ii) consequently direct the respondents to appointment the petitioner as Anganwadi Worker of Muthapur Village, Ribbena Gram Panchayat, Mandal Bheemini, District Adilabad w.e.f. 1-1-2007, duly granting all other consequential benefits, such as back wages, continuity of service etc., (iii) and pass such other order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case.”

2. Heard Sri K Vasudeva Reddy, learned counsel for the petitioner.

3. At the time of admission, this Court, by order dated 05.09.2007 in W.P.M.P.No.24145 of 2007, granted the following interim direction:

“In view of the same, there shall be interim direction to the respondents to appoint the petitioner as Anganwadi Worker of Muthapur Village, Ribbena Gram Panchayat, Bheemini Mandal, Adilabad District, without insisting upon the SSC qualification, if she is otherwise eligible as per law.”

4. A counter affidavit has been filed by respondent No.1 stating that the petitioner does not possess the requisite qualification for appointment to the post of Anganwadi Worker. The petitioner has studied only up to VII Class, whereas the minimum qualification prescribed for the post is S.S.C. It is further stated that, during the pendency of the present writ petition, another person filed W.P.No.18115 of 2007 seeking appointment to the same post, and the said Writ Petition was allowed, pursuant to which the said person has been appointed as Anganwadi Worker.

5. It is evident from the records that the post of Anganwadi Worker has already been filled by another candidate who satisfies the prescribed qualification criteria. Furthermore, as per the counter affidavit, the petitioner does not possess the required S.S.C. qualification.

6. At the time of filing the Writ Petition, the petitioner was 32 years of age. She has crossed the age limit prescribed for appointment to the post of Anganwadi Worker.

7. In view of the above circumstances, nothing survives in the present Writ Petition.

8. Accordingly, the Writ Petition is closed. However, liberty is granted to the petitioner to approach afresh, if anything survives. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, in this Writ Petition, shall stand closed.
