THE HON’BLE SRI JUSTICE J. SREENIVAS RAO CONTEMPT CASE No.2495 of 2025

ORDER:

This Contempt Case has been filed by invoking the provisions of Sections 10 to 12 of the Contempt of Courts Act, 1971, seeking to punish the respondents for non-implementation of the orders passed by this Court on 17.02.2025 in W.P. No. 3668 of

2025.

2. Heard Sri S. Prabhakar Reddy, learned counsel for the petitioners, and Sri G. Madhusudhan Reddy, learned Standing Counsel for the GHMC, appearing for respondent Nos. 2 and 3.

3. Learned counsel for the petitioners would submit that, in spite of the specific directions issued by this Court while disposing of W.P.No.3668 of 2025 on 17.02.2025, the respondents have not taken any steps to comply with the orders passed by this Court, and therefore, the respondents are liable for punishment under the provisions of the Contempt of Courts Act.

Per contra, the learned Standing Counsel submits that, pursuant to the orders passed by this Court, respondent No.2 initiated proceedings under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (hereinafter, for brevity, referred to as “the Act”), and issued a Form-C notification dated 26.09.2025 under Section 11 of the Act, and a notice in Form- VI(B) dated 26.09.2025 under Section 15(1) of the Act read with Rule 21. It is further submitted that the respondents will pay compensation to the petitioners as per their entitlement under the provisions of the Act, and a copy of the same has been placed on record.

5. By way of reply, the learned counsel for the petitioners requested this Court to direct respondent No.1 to conclude the land acquisition proceedings within a stipulated time frame.

6. The learned Standing Counsel submits that the respondents will conclude the proceedings in accordance with the provisions of the Act.

7. Taking into consideration the aforesaid submissions, the Contempt Case is closed. However, respondent No.2 is directed to conclude the land acquisition proceedings and pay compensation to the petitioners as per their entitlement, as expeditiously as possible, preferably within a period of six months. In default, the petitioners are granted liberty to file an appropriate application for revival of this Contempt Case.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
