COMMON ORDER

Heard Smt. Dr. J.Vijaya Laxmi, learned counsel appearing on behalf of the petitioners and Sri T.Rajinikanth Reddy, learned Additional Advocate General appearing on behalf of the respondents.

2. The petitioners approached the court seeking the prayer in W.P.No.15836 of 2024 as under:

“….to issue a writ order or direction more particularly one in the nature of a writ of mandamus declaring the actions of the respondent Nos. 1 to 6 in issuing circulars/Letters No. c1/718/2024, dated 23.03.2024, Lr.No.G/9046/2018, dated 19.042.024, Lr. No. G/9046/2023, dated 12.06.2024, Circular Rc No. G/2000/2014, dated 11.06.2024 and Lr No. 301/Parlorurs/13861/DD/MBNR/ MS/2024, dated 10.06.2024 wherein the respondents granting the Government contracts on nomination basis without public auction or open tender as illegal, arbitrary, unconstitutional without due process of law and in violation of Article 14 of Constitution of India and consequently to direct the respondent to call for open tender where by all farmers cooperative diaries can participate through a transparent process emphasizing on integrity and equity and pass such other order or further orders…”

3. The present contempt case No.1259 of 2024 is filed, complaining violation of the orders of this Court dated 24.06.2024 passed in I .A.No.01 of 2024 in W.P.No.15836 of 2024.

4. The case of the Petitioners, in brief, as per the averments made in the affidavit filed by the Petitioners in support of the present writ petition is as under :

It is specific case of the petitioners that the petitioners are distributors of M/s. Shreeja Mahila Milk Producers company in Telangana State having a recognition letter from the Government of India recognising this company as farmer producer company owned and operated by farmer members and the petitioners supplied milk successfully for the year 2023-24 vide Lr.No.H4/1287/2023 issued by the office of the District Collector, Sangareddy and Regional Co-ordination Officer to the Minority Welfare/Social Welfare/SC Welfare/Tribal Welfare/Jyothibaphule(BC Welfare) to all the residential schools and colleges under its jurisdiction in Sangareddy and Nalgonda at the rate of Rs.55/- per liter including transportation and found that the rate offered by the petitioners is economical as compared to other diary milk which is less than Vijaya Diary and Karimnagar Diary which is offered at the rate of Rs.58/- per liter and Rs.2/- for transportation totalling to Rs.60 per Liter.
